From what I remember in class about M'Naghten it was a high standard for the defense to prove in states like NY, VA could be different, idk. He's going to be examined by more than one psychiatrist but despite all his sperging about the Merge and Magi Chan it's going to come down to his understanding that what he did was wrong and his attempts to hide it.While I'm not willing to bet anything, I feel like he'll be institutionalized as well. I personally don't think his condition qualifies him for not guilty by reason of insanity, but I suspect that the defense will argue that his condition in conjunction with the coaxing meets the M'Naghten standard for him not understanding whether his actions were right or wrong. On the flip side of that though, Virginia statutes place the burden of proof for insanity on the defense.
Also while Chris clearly isn't firing on all cylinders he manages to function, ie he isn't, and never has been, living on the streets ranting like a typical lunatic, eating out of garbage cans and sleeping in dumpsters to keep warm. Especially since Barb is out of it and he's been able to manage for both of them, regardless how minimal it may have been.
I imagine what the managing attorney at the local public defender's office might say at the case meeting: "Wait, this guy is 39, is on SSI and has an army of internet fans that buy his shitty work and pay for him to shill his crap at conventions yet he fucked his senile mother, even tying her up? Make sure he understands what's going on and what the possible outcome will be, get him to plead and maybe see if you can get him some psychiatric help but remember we have a huge caseload so don't spend too much time on this".
