They might not have enough to actually convict him of rape, but enough that anywhere with an opening for another tard is going to turn down a potential sex predator. After all, if he shows up and rapes another tard, the liability is on them.
This is true. The Autism Defense seems to have not been modeled over what Chris had done, but more prosaic crimes, such as a tard looking at something at a store and wandering outside because they're a retard and got distracted and legitimately forgot to pay for it or put it back.
Then again, Virginia is not exactly in an unknown land with sex crimes. When Chris got arrested, there were at least two other folks being investigated/charged with diddling activities in his locality, so the argument that they're completely at a loss for dealing with sex crimes isn't valid. I think the big sticking point with Chris is that yes, he's autistic, and pretty stupid, but at the same time, knows what he did was wrong. The courts need to prove this, thus with how thorough of testing Chris has undergone to prove this. I can't imagine, after going through evaluations at JMU's forensic lab, that those types of professionals are just going to go "Yep, he's autistic and had no clue what he was doing was wrong", and Chris sinisterly smirking that he got one over them because he was only pretending to be retarded.
Chris's big issue is that it took him until he was nearly 40 to be put into "the system". A younger tard would have been able to be trained but by now, Chris is stuck in his ways. He also knows how to game the system to a point given he knows there's no punishment for refusing to deviate from his current copes. He can literally say anything, and understand that no matter how much a trained professional tries to retrain him, that there is no punishment for him not doing it.
It's also worth noting that the things that really got on Chris's ego, was events like the hogtying incident at Target, or anytime the "jerkops" got physical with him. Those events really traumatized him, just like the bondage chair incident at Western. Now? With Heilberg reassuring him that despite these serious charges, society will provide him with a place to live, money to buy shit with, there's zero reason for him to change in any way.
Not to a-log, but if there was something like, some negro coming to beat the shit out of Chris if he fucks up, and it's happened before, that might make a difference, but the justice system seems to has its hands tied this time.
