Restreaming your "content" is not illegal so long as commentary is being added. Calling Tevin a criminal is the same thing as when "detractors" call you a "criminal" for stealing people's money, they're technically wrong and so are you. Gonna disagree that it's clearly not illegal. The H3H3 lawsuit set up some parameters for legal use of others' videos (at least on Youtube). The judge made a distinction that simply talking over the whole video while it played would be illegal because you would be providing the full video, even with your own commentary, which is not considered fair use. If this was not the case, anyone could do an MST3K-style "reaction" video and show full movies and whatnot under the guise of commentating on it. Sidenote: this shows that Phil is completely wrong (SHOCKER) when he said that nobody had taken this issue to the courts. H3H3 was found to have been protected by Fair Use because they only showed portions of a video and then cut to themselves responding to / commentating on.

TL;DR: TIHYDPs are almost certainly protected so long as they provide some criticism / parody / commentary and don't simply replay the entirety of one of Phil's videos. Tevin's restreaming is less likely to be protected by Fair Use because he's showing the entirety of Phil's "work", even though he's commenting over it. I'm not a lawyer, but I think a big question would be whether Tevin occasionally stepping away from stream to pull up old videos that contradict something Phil is currently talking about would constitute Fair Use.

Legality aside Tevin's content is arguably as transformative as Dsp's. You could argue that viewers of Dsp stream's don't get the full interactivity of the game since the stream limits them to experiencing Dsp's gameplay choices, and that the focal point of the stream is their interactions with Dsp and his commentary. Likewise Tevin's commentary and viewer interaction is the focus of his restreams, and his viewers don't experience the full interactivity of a Dsp stream because they can't interact directly with Dsp or influence the content of the stream.

These cut-aways from the actual stream could be argued to be 'transformative' as they are additions used to clarify or expand on a point with information taken from another source and serve to further a narrative.
