Sick Nick Sentencing Game

If I'm reading this dog's breakfast of a sentencing guideline correctly, the suggested range for the most serious of Nick's offenses, 18 Pa. C.S.A. § 3123(b), assuming Nick has no priors, is "72-SL," which I believe means 72 months to the maximum. So 6-40 years. It would be nice if we could see the prosecution's sentencing memorandum when it comes out, and I'll look at this more.

Will the defence have an opportunity to submit evidence or anything at sentencing on behalf of Nick, in an effort to lessen penalty or get him committed? That is what I am most curious about. It makes it difficult to know range of sentence without factoring potential for sympathy card.

However, I will make a fake twitter if I win. I think he will get 4 years each on the minor charges, 15 on the big one. Eligible for parole after 2/3rds served. Submit DNA sample and registered for life as a pedo.

With that said, it doesn't matter. Anything more than 5 years and it is a death sentence. I am going to lean towards him not living more than 5 years in prison. Given him, his crimes, and apparently a hardass prison.

Unless he gets put in a pysch hospital or something, he will die before his sentence is up in my estimation. Ailments, suicide, death by misfortune or murder, one of them will get him I think.

"But you see, the kind of suffering on this scale I'm hoping to inflict is really beyond me. I'm just a soldier. I need the skills of an complete and utter sadist. "

(phone rings)

"Ah. Splendid. We have him restrained in a deep cell. Starting now, I want you to kill that bastard creation as slowly as humanly possible. I want you to employ every bit of skill, ingenuity and malice that made Frankie Toscani a byword for a unnecessary, extremely prolonged, painful death."

Here's my guess.

15 years with possibility of parole at 5.

30 years, parole in 10.

32 Years with time off for good behavior (because Nick will mostly sit in his cell in a semi-catatonic state; keeping his head low and not making waves, sooooo, technically, he's behaving himself.)
This will be followed by institutionalization in group home for the rest of his natural life.

I will, however, add a caveat.
I prophesize that within a couple years in that group home, he'll re-offend and end up back in the joint.
THEN he'll come out feet first.
