The ESRB (or PEGI, or CERO) excuses are just an attempt to point fingers. Many of the games being censored are teen rated (like Senran Kagura) which makes sense when these games often aren't that violent and are the game equivalent of Baywatch.
Sony and Nintendo already have a blanket policy of no AO rated games on their systems, but these games wouldn't fall foul of that so they need this extra layer of censorship to stop them.
