Yes this is possible however it does not necessarily absolve you of responsibility for your actions. In practice the bar for 'mental retardation' as a reason for lacking capacity is very high and one does not reach it without having been diagnosed by the medical establishment with some form of mental abnormality; often some form of low functioning autism. As mentioned above the line for lacking legal capacity is both strict and severe and without a diagnosis in practice one needs to be completely unable to function, Len is a pants shitting moron but he's a pants shitting moron who can drive a car and use the internet (which illustrates just how low functioning someone who lacks capacity must be).

I should probably have clarified that borderline mental retardation in a medical sense and being near what the courts think of as mentally incapable is very different.

I don't understand how his mother can deal with him. Honestly Lens mother could die right now and he won't notice till next month that she died cause he sits around sperging about trains. It really doesn't matter unless he's so incompetent that he would be literally incompetent to stand trial.

Or if capital punishment were on the table and he were too retarded to be executed (Atkins v. Virginia). Neither of those is the case.

Legally, Shaner is not only competent to stand trial, he's competent to represent himself. In a legal sense. In a practical sense, he's incompetent along basically any relevant axis.

Unless sears has a giant warehouse in the back, I seriously doubt they would have a motorized forklift. Retail stores will have a pallet jack, which lifts loads 6 inches at most and a retarded monkey like Len can operate.

I don't know if they are common in the US but you can get some VERY small FLT's in Europe for small but tall ware houses. But your right he probably thinks a pallet pump truck and a work place safety / training cert counts as a licence.

Just from an armchair doctor's perspective, he might have a nasty combination of inbreeding and fetal alcohol syndrome (FAS).

It has been mentioned his family tree curves in on itself a few times. His german ancestors have lived in that same town for almost 300 years, never breeding outside the community.

FAS is similar to autism, and the two disorders are often confused (I'd be willing to bet a large chunk of people on this very site actually have FAS, not ASD) It is a spectrum development disorder that can cause rigid thinking and other autistic traits, but FAS adults have greater issues with anger and resentment, and have other impulse control issues. They are also not as rigid as autistics, more able to "go with the flow" as it were.
Plus, Shaner has a wierd looking face.

That wouldn't surprise me judging by both his looks and habits. But especially his habits. I'd personally say it's a possible mix of FAS and autism, but that's just me.

Len's full of shit. There was/is no forklift. We used dollys, jacks and the occassional electric walkie stacker which is a forklift you can't ride and need no classification or training to use. But even then he was never allowed to fucking touch it because he would ram it into the fucking double bay doors to the warehouse. He also "accidentally" pushed it off the loading dock in a tardfit, letting it fall a good 8 feet into the concrete truck bay. Guess who had to wheel it back out to the front and back into the fucking store.
