Yes this is possible however it does not necessarily absolve you of responsibility for your actions. In practice the bar for 'mental retardation' as a reason for lacking capacity is very high and one does not reach it without having been diagnosed by the medical establishment with some form of mental abnormality; often some form of low functioning autism. We're talking unable to speak or dress oneself or a combination of something similar.Now that is interesting, is it possible to be that dumb you create a conspiracy to excuse your own actions and shift the blame because your mentally incapable of rationalising your own actions to your intent.
As mentioned above the line for lacking legal capacity is both strict and severe and without a diagnosis in practice one needs to be completely unable to function, Len is a pants shitting moron but he's a pants shitting moron who can drive a car and use the internet (which illustrates just how low functioning someone who lacks capacity must be).My opinion is Len is right on the line of legal retardation, like Phil he is marginally able to take care of himself but he need's massive amounts of assistance to do so and a qualified wrangler to keep him out of trouble.
I should probably have clarified that borderline mental retardation in a medical sense and being near what the courts think of as mentally incapable is very different.
My original point was its perfectly possible he has no mental defect to use as an autism crutch and is just that dumb- which i think is hilarious!
