German laws regarding self defense are pretty much equal to "stand your ground" self defense laws, just saying.
You're not required to flee from the threat, you are not required to seek the least harmful method of fending off an attacker, you are not required to analyze the situation on how big the actual threat is and the law outright states that any act of self defense is legal.

While this is likely to be appealed, Dragonlord has been sentenced to two years in prison with no chance of probation, due to multiple counts of insults and infliction of bodily harm (towards visitors).
He had previously been sentenced to 7 months probation for pepperspraying a visitor.
Originally a verdict was expected on the 28th (two days were scheduled) but they got through it in a single day.
The defense asked for 2 years on probation (citing Dragonlord's willingness to move and lay low, having recently sold his decrepit ruin house which he will move out of in January), the state asked for 2.5 years without probation. Judge "compromised" on 2 years without probation.

A couple of explanations as to his background and pre-youtube existence that may not have been covered by Dankula can be found in the previous pages, where the Germankiwis have been switching to English in anticipation of this event.


To clarify : Insulting people publicly (or disseminating insults through a public medium) is punishable under German law. Rainer regularly insulted the police and individual policemen / patrols in his streams when they did not arrive fast enough for his taste (he would call them multiple times daily, basically whenever someone visited him and expected them to show up within minutes)

Looks like gross incompetence of the judge or we're not told the entire story. If the shopowner escalates the fight, self-defense is off the table as well. It's kinda odd how the guy who was winded and on his knees managed to produce a club so quickly, don't you think?
Either way, as we Germans say "Ausnahmen bestätigen die Regel."

How about the old guy who shot an Albanian in his basement with his hunting rifle? Dude got off scot free cause it was deemed perfectly valid self defense and the judge in that case made it a point that the circumstance that the Albanian had no route of escape bar the very stairs that the old guy approached him from was of no consequence to the act of self defense.
