Autism, and it's hardships are one thing, and can often seem similar to sociopathic individuals in certain respects. But imho , Chris exhibits low skill planning and disregard for major consequences (reputation, health, financial.) And impact, consistently.

People tend to forget most folks who would fall under the old sociopath banner, are not the guy from American Psycho , or the zodiac killer. Most let their poor impulse control and lack of ability screw themselves over pretty quickly.

By the way, for the legalfags here, what types of probation are there? Does a single failure to meet with your probation officer result in automatically going back to prison, or does it mean that they tighten the terms if your probation period or lengthen it, first?

If it's nothing too terrible, a slip up usually results in a warning. Repeated violations get you locked up again. It really depends on what you did and how your probation officer feels about it.

The fastest way to get sent back is to do something related to what got you in trouble in the first place. In Chris' case that would be trying to go see Barb again (if not authorized to do so). That would get him sent back pretty quick. By extension, that would also mean going back to 14BC.

i love how people think Chris is so lucky, he's got a year in prison without trial. if this was someone people cared about people would be mocking the continuance instead of sperging over it. this is a pretty big violation of rights, remember that whole "speedy trial" amendment? this is exactly what it was meant to prevent. continuance for years on end. look at mercedes careera, chris could be continuanced for 4 years. which would be way past any max sentence for what he's accused of.

Chris has the right to a speedy trial *if he wants it*. You are free to not use that right if it will not lead to a better outcome.

The right to a speedy trial is there to protect the innocent and people who have committed very minor crimes. I covered this in the FAQ.

Exactly. One of the things usually expected for this type of deferral is for there to be a full time tard wrangler. A parent willing to keep Boo Radley locked away inside the house and away from public concern. But Chris FUCKED HIS SENILE MOTHER. This will be somewhat limiting with regards to Tard Wrangling options. And nobody will be going out of their way to secure him a comfy bed in a group home. When they kick him loose the County will give him a 30 day voucher for the No Tell Roach Hotel down off the Interstate. (Which will lead to complaints from the resident hookers, child molestors and meth heads)

Do you law talkin kiwis see any concern about this setting any damaging legal precedence should this strategy somehow work? Like every rapist on the spectrum(let’s assume it’s a pretty fucking high percentage) is going to start using the Chandler v Virginia defense?
 
The language of this leads me to believe that since the judgment would be deferred and Chris would be released on probation, ANY violation of the probation will lead to an IMMEDIATE guilty judgment (and typically also facing maximum sentence for the original crime) along with the charge for the probation violation.

This would be a powder keg, but it's a tactical move on Heilberg's account because he can get Chris the fuck off his plate.
The language of the statute leaves terms and condition of the probation up to the court, including the consequences of a violation.

They created the statute so that it would be a possible outcome in situations that meet the criteria. The fact that someone met the criteria (if he does/did) doesn't make it more likely that others will also seek to use the statute for it's intended purpose.

I won't need to if he becomes homeless. Friday's After Five is in downtown Charlottesville where the homeless populate. It'll be entertaining to see him try and mingle with the established population.
It feels like a more distant, innocent time where you once joked about Chris becoming homeless and running afoul the other, even more crazy homeless cats in Charlottesville. Now it’s like it’s not “if” it’s “when”.

Question is: should you see homeless Chris in the wild, would you give him a few bucks?
 
One nice thing is that this completely destroys the high-functioning diagnosis that Chris always held onto tightly. While it may get him off on serious charges, Chris will always have the "really not all there" label, on paper. Also confirms that people should be afraid of his autism for good reasons. Should at least make future bans a lot easier.
