stupid question perhaps, but is incest a sex crime? although sex is a factor, it certainly isnt sexual assault in and of itself

i firmly believe Chris did not rape Barb, not legally speaking that is

Chris is never going to be convicted for this, yes he probably did it but the court is going to need a little bit more than words from a madman with absolutely zero grip on reality and hallucinates his imaginary friends and words from a dementia ridden old woman who probably cant remember her late husbands name.

That's really all there is in terms of "evidence", and it's probably why this case is taking so long because the prosecution is probably stalling for time to get something against chris,.

Reason why he's being let out is probably because this case is going nowhere and they finally found a place to dump chris off at

Call me optimistic, but I’m going to suggest that Chris might be silent because he’s been getting treatment/medication for a year and it’s working. Normally, the court can’t force someone to be medicated or undergo treatment; but they have far more leeway to make that a condition of deferral which is technically “optional.”

The way Chris went from sending spergy letters to people to cutting off contact suggests that at some point it got through to him that continuing to engage with internet randos was not in his best interests, He's had quite a lot of time to get used to the absence of that contact now and his lawyer would have drilled into him how high stakes this release period is if he wants to avoid further incarceration.

I'm not sure that Chris can remain silent long term indefinitely, but it's possible he can do so for the short or medium term. iirc, there's been at least one previous period when he retreated from the internet for a while (I want to say it was prior to the fire).

I dunno, the maximum sentence in Virginia for incest is 12 months from what I understand so getting a deferral for autism and being kept in jail for over seven months longer than that seems quite extreme if the courts didn’t think it was legally rape.

That's the minimum. It's felony 5, which is 1-10 years (though it wobbles with the jury or judge able to lower it to the misdemeanor again).

It was 12 months before they upgraded it to a felony to continue holding him.

I seriously doubt they'd have held him on a misdemeanor for a year, then upped it to a felony, then just given him a deferred adjudication and released him if they were intending to file rape, which has a potential life sentence.
