I think if (or when) his motion for summary judgement fails, Nick will also declare war on the judge. It would be an even bigger mistake, but I don't see him not doing it.
In February he said "I'm not going to say anything about this judge yet":
At 12:05 he comments about Judge Jennifer Fischer. He responds to a question about the judge by saying "I know a ton about the judge over my case" but adds "I'm not going to say anything about this judge yet." He then tries to do some cleanup but saying what he would say would not be "anything particularly negative".
I have not seen any of last night's (well, this morning's, really) Locals stream, but if
@Himedall All-seeing Waifu is correct in his characterization that Nick "is confident that he is going to win, but it still stresses him out because the judge might not be smart enough to understand the law", that suggests to me that he might let loose on the judge.
The reason why is pretty simple. The portions of Randazza's filings related to choice of law and the Colorado anti-SLAPP are well written and well researched. The portions that are relevant to the actual facts of the case, well, you have to work with the facts you are given, and in this case it looks a lot like Rekieta got drunk and said some shit he didn't expect to have to defend in court because he thought a total weirdo like Monty would never be able to find a real lawyer. Now he's forced to find one of the most prominent lawyers in his field in the country to try to apply the laws of a state with a very generous anti-SLAPP.
The change of tone from January where Nick would sit in his hot tub laughing and joking about the case to last night seething about the "scumbag" lawyer from Willmar, Minnesota is extremely stark. And I suspect that part of the reason for that might be that he's starting to get afraid the Colorado gambit might fail, with some probability, and
if it did, this thing's probably going to discovery. At the rate Nick's spending money, discovery has to create a bill for him DEEP into six figures, unless he decides to cheap out and change lawyers, hiring a local attorney.
So I do think if the judge declines to dismiss the case based on Colorado's anti-SLAPP, Nick will lash out at her. That's what he does. The alternative for Nick is to accept that he has to shoulder the blame for his own problems.
