You have to look it up in the general district court not circuit court. Case number for Greene General District is GV16000416.

I was in the area due to work but I didn't see them. Doesn't mean they didn't show up since it was around 12:00.

Thanks, I found it now. Didn't know which district the case was in.

Still nothing right now *sigh*...

No offense but those are older proceedings. Look at the hearing dates. Here is the info for the 2 recent proceedings against Barb:

The site for anyone to check is here:

http://www.courts.state.va.us/caseinfo/home.html

Select General District Court and then accept the agreement. At next page, choose Greene County, and then do a name search under Civil.
Cool, thanks for finding those. I was using the website that was linked during the last trial.

I really hope this makes Barb bring enough heat down on Chrissun for him to get desperate. Mostly because it'll mean him pestering his rich city-livin' brother in Carnegie Hall again.

cole smithey would probably give his mom and half-brother money if he had any, what does cole do that would earn him large amounts of extra income? That comic is just shameless manipulation.

lol @ people expecting the court gives a flying fuck about this case.

Would they be forced to sell their home?

Only if the creditors saw fit to get what in the UK is called a charging order and then see fit to enforce that by order for sale.

The question, though, is how much is the debt, and how much is 14 Branchland Court worth? Remember that securing any judgements on it will be at the bottom of the heap for priority. It may be that Barb is in negative equity, and given the state of 14BC and house prices in rural Virginia not exactly being very large, the creditors might adopt the attitude that Barb is "judgement proof."

Or, they could just send in the bailiffs to repossess the horde. But how much would they get, at auction, for heaps of strangely malodorous Lego sets, furniture embedded with the stench of rotting fish heads and old and crispy sick, and Pokémon cards with a thin film of nameless dried grime all over them? Even Chris's car can't be worth all that much because it's aged and probably hasn't been properly maintained if at all.

The judge will realize that she only has one thing to pay with. Her life. She will be shipped off to a African penal colony where she suffer the rest of her days digging up diamonds for the empire

Actually, I'm hoping Barb gets one of those "creative punishments" judges, who sentences her to stand out in the street carrying a sign detailing her misdeeds. Deep inside that souldead hoarder is an insecure lower-middle-class Southerner, whose spirit is still susceptible to crushing just a bit further. So much for royalty!

It's going to end with either a straight out default judgement or a consent order. Neither is very exciting until Barb defaults down the track and Cap One seeks to enforce the judgement/order.

Up to $5,000.00 worth of household crap is exempt from process. Va. Code. § 34-4. There are a couple other specific and strange exemptions in Section 34 (like the family Bible) that might protect more crap. I have only seen a creditor go after household stuff once and that was under some very strange circumstances.

I haven't checked Virginia specifically, but I would not be surprised if any judgment would be a lien on the real property, but execution (foreclosure and sale) is somehow barred. It's something that would have to cleared up if the property was ever sold and would prevent a refinancing without being paid off. Even if execution is not barred, foreclosure is a real pain if you are not the mortgage holder.

Generally creditors like to garnish bank accounts. Fast and easy.

Do "point in time" garnishments exist in the US? That's when a creditor garnishes up to the balance of your bank account on a one time basis without notice. They're used a lot by the government here when people either don't make or don't keep payment arrangements and they certainly get people's attention.
