I’m sure that’s what he’s been advised to do also, can’t imagine telling your audience about the lawsuit is a good idea. Pretty sure that the three-letter agency most likely to go after the streamers would be the FTC, depending on whether said streamers declared that they were getting a cut of donations during the charity stream or said something like "all donations made during the stream go to <charity x>", which is tantamount to not declaring a sponsorship and a form of misleading advertising (I would bet that they did this).

IRS would only be interested if the take wasn't declared as income, which would be extremely stupid.

Regarding Softgiving, I would be surprising if this entity was even incorporated as a nonprofit - they're probably a private company operating as an advertising agency.

The charities are pretty safe if they declared the deal as a promotional expense. This doesn't make them any less scummy, but I would call the majority of "charitable organisations" are virtually legitimised criminals these days.

NB: I am not from the USA, and if I got something wrong and missed an avenue through which the IRS  can get at these scumbags, please correct me.

As suggested above, if you want to give, give directly to a person in need. Otherwise, religious organisations (Christian or Islamic specifically) tend to have the lowest overhead - provided the church itself is legitimate and not some self-enrichment scheme.

Asmongold, xQc, all of OTK, Ludwig, Hasan, amongst other famous streamers, have all been exposed by a journalist named Jacob Wolf of promoting a charity scam by a company called "Softgiving", now known as "Brandfluence" (A)

The TL;DR of the article is that all of these streamers had streams where the promoted various charities run by Softgiving, and said all of the donations made during the stream would be donated to those charities. However, 42% of all the donation money went to Softgiving's wallets, and not to charity.

The only streamer to respond publicly so far has been Asmongold, and he did it in his typical scummy fashion, by acting like a Internet Tough Guy and then saying "who give's a shit" if people got scammed, and then he fucking bans the user who asked about it.
