There is no “copyright claim” here, and seeing as Phil is a public figure, he doesn’t legally have a pot to piss in.

Fact: Yes you can take pictures of people in public. No you don’t need to ask them. Yes you can even monetize it.
On top of that, Phil streams on YouTube, which means that he has already signed away any kind of rights he may have had.
Plus he’s a public figure, which arguably makes him fair game.
Whether they "could" get away with it is still to be seen. The dev probably has some sort of recourse. If steam is anything like YouTube they can file a counter claim, but I don't know anything about that though so correct me if I'm wrong here.
