Is that not Saddam's likeness retard? Is that not a literal image of his literal face that they are transforming into an original work? What about David Hasslehof? Tell me how this is not the same thing dude. It's so obviously transformative I don't even know what to say. Steam just took it off because they would rather play it safe than deal with copyright bs (same thing Youtube does)

What are the odds of this little studio going bankrupt in the near future? I want to see Phil outlive another company for shits and giggles.
I also expected that 2/3 of the time especially after Steam pulled out the Dolphin emulator and even got into contact with Nintendo. They're better than their competitors in many ways, but Valve still aren't your friends.

I am genuinely surprised anybody here supports this game getting taken down for copyright violations. Very clearly fair use / parody. Nobody is forcing you to play the game or pay money for it. It’s a rather innocent joke project; imagine white knighting for Phil of all people because he got a video game made about him parodying his existence that repurposes and transposes, god forbid, IMAGES of and AUDIO of The Guy. Fagified L take, embarrassing really.

I would argue that this game falls under fair use, as it is a parody obviously, and it takes liberties, but I think because the creator is making money off Phil's likeness, that might be where the issue is. I could be wrong, I don't know anything about copyright law and where lines are drawn.
Take for instance the Friday the 13th game. That game had to pack it up when the Horror Inc./Victor Miller lawsuit started. Fans recently were recently going to release an updated version of the game (For FREE mind you) and were still served a cease and desist from I think Horror Inc. Now this isn't apples to apples as that game isn't a parody, and wouldn't fall under fair use but it was being released for free, which is how Fan Films of popular IPs skirt around lawsuits. But I'll assume in the F13s game case, because it was using all the assets from the original game, that is what got the fan update killed.
The Detractor uses 100% (as far as I Can tell) original assets aside from Phil's face. It will be interesting to see how this one shakes out.

I don’t care if it’s copyright infringement, free use or whatever. I think this game is funny and harmless and should be left up because it is funny and harmless.

Copyright is a very complicated law that also varies through different countries but even the US copyright law is very vague and questionable. But I do agree that the takedown is bullshit in my opinion.

That's correct. It was killed because it was unlicensed usage of their intellectual property rights. The general rule is that IP holders can C&D at any time, regardless of whether it turns a profit it or not (in the case of fan films, those using sites like IndieGoGo are just fulfilling backer rewards, there is no actual profit made from the fan films themselves *as it were*). For Horror Inc., they've gone after every one of those fan games simply because they can and Sean Cunningham is mad that he lost the lawsuit so he's taking it out on everyone in F13's case.
With Phil's stuff, he's claiming copyright infringement so it still raises the question of how do you prove it isn't taken directly from his channel, or what other kind of strategies could be used to have it removed. The pricetag is really the biggest red flag in all of this.

If the developer wants to fight it can't they countermandate it? Steam's actions sound a lot like the Youtube system where the platfrom pulls the plug quick when it comes to copyright so the platform can't get sued (I think platforms are "encouraged" by the laws to pull stuff quickly) and it falls to the user to provide evidence that it is indeed fair use. Remember the Channels Super Fag tried to kill? That took a while to clean up

The difference of course being Hasselhof is in on the joke as are Comedy Central, the entity who would be liable for the broadcast.
Fair Use was intended to protect educational content. It goes away once you try to profit off other people's likenesses. You might have an argument if this game was released for free,

I am interested into if the takedown has legal merit or not, but I am a big retard when it comes to the US law and the copyright law in general.
It being transformative seems to go more into the fair use dirction.

I am probably asking to much when I ask for a rough estimate in which area the game would more likely be in, but I don't see this going to court ever.

Were Tom Cruise or Kanye “in on the bit” when South Park parodied them as well? I seem to remember them both getting really upset and the episodes staying up despite that fact.
EDIT: or is this specific to their actual face being used as opposed to a cartoon likeness? I don’t really understand the difference as the bodies are still obviously altered and cartoonized in either case

Comedy Central made a calculated risk giving South Park the freedom they have in publishing that stuff and the money they'll generate from it to defend any action. That and the fact that the targets of those jokes would be self-harming their own reputations further by pursuing legal action. Steam wants nothing to do with that risk or any negative attention they might get from this type of harrassment. How hard is that to understand?
TLDR: DSP is a piece of shit but you guys are bigger pieces of shit.
