This was before any court appearances (video was posted in June 2003, I believe the district court hearing was July, 2023).
Assumption is 10-20 grand per appearance and preparation, (so an additional 20-40k per appearance for Randazza and the other MN lawyer), plus probably another 20-40k for the appeal prep. I could estimate appearance costs further, but 1st class flight, top shelf stay for a few days, meals, car, etc., it adds up quick.

Randazza's estimates for costs range from 50k up to 300k if being sued.
Damn, has this case been going on for nearly 21 years now? Time flies! If I'm being conservative here, Nick must be in for $13 million at this point.

Nah, his SHEER FUCKING HUBRIS demanded he get the most expensive 1st amendment lawyer in the country and thought he could pass the bill onto his audience. Which he then squandered away as fast as Bossmanjack squanders 70k.

There's no way I can see this not resulting in contempt of court, and that's really the only way this whole thing could get funnier. He'd have cow of the year in the bag if he went this route.

He missed the bus, his paying audience was gone by the time he went full tard on Montegraph, his show was in its dying throws already. He was maybe pulling in about double what he pulls now, as it’s currently $0-$150 per show, iirc, when he called Montegraph a lil boy sucker, he was maybe topping $300 per stream, max.

ETA: I may not be spot on in this memory, though it was clear Nicks shows were no longer bringing the big money anymore. That was the point in that statement.

First of all, even lawyers are not really supposed to represent themselves.

Secondly, if that happened, Monty would be doing donuts in Nick's Mustang right now, and Nick's head would be on a pike in front of the courthouse as a warning to other lawyers.

It amazes me how so many people still don't grasp what a shit lawyer Rackets is. And this is Steel Toe, FFS. Did they not get the hint when he no-showed on April's speeding ticket?

Nick was so confident that he even reacted to himself calling Montagraph a "child diddler", and by react of course I mean he giggled and nodded along with his own comments. This was how Nick imagined himself grifting off of Montagraph, with everyone laughing along with Nick as they showered him with thousands of grift-bucks:



Nick's strategy of doubling down on whatever he said was supposed to benefit both his case and his channel. Now that both are decidedly on the decline, Nick has no one to blame but himself as he continues to pay large sums of money for this lawsuit so that people can continue to laugh at him.

The proper method to deal with the Montegraph lawsuit would be to issue a retraction, apologize, and give a small settlement sum to Montegraph to make the issue go away. The facts demonstrate as clear as day that Nick committed defamation, and I would bet Montegraph would have been amendable to a fair and reasonable settlement had Nick not acted like a complete fucker. Nick made the whole issue a ruinous suit to the death where he's doomed to lose.
In one very real sense, Monty has already won.
Nick should get out ASAP, but he's too prideful to admit defeat. Nick's entire strategy seemed to hinge on recovery of Randazza's fees, justifying the insane costs of suit on the basis he could eventually recover at least a portion of his fees. Without a vehicle to recover attorney's fees, continuing to participate in the lawsuit only serves to burn far, far more money than the case could ever be worth.

Continuing the lawsuit at this point probably will be worse than straight up losing. The problem is that since Nick has been such an outrageous cunt for the last two years, the attorney's fees already accrued on this case are likely completely ridiculous, and Montegraph now holds basically all the negotiation leverage, settlement will be next to impossible.

I don't know if any anti-SLAPP lawyers actually do this, but it would make sense in a state like California where anti-SLAPP means you collect your fees from the losing plaintiff. I see it as seriously unlikely to go for contingency in a state without an anti-SLAPP statute by advancing an arcane choice-of-law argument that another state's law applies, and not just for the procedural aspect of dismissal (which is almost never going to apply) but also for the substantive aspect of fee-shifting.

I'm virtually certain Randazza is not dumb enough to do that without cash up front.
That was what happened to Quasi, and it took how many years to get paid? I could only ever see doing something like that against an in-state defendant who you 100% knew was going to be collectable. Even then it feels like it would be more of a favor or a stunt than something anyone would do as course-of-business. I never agree to do contingent fee work against "normal people" because the risk of an uncollectable judgment is just way too high.

And by "win" I mean he might "win" at trial but he's out so much money for so little cost to Montagraph that he's already lost no matter what happens. Just going to discovery at all is losing. Because Randazza isn't Jesus Christ Himself and can't make "sucks little boys' dicks" non-defamatory.
The only trial strategy that ever wasn't totally retarded was to get someone good but affordable to push it to trial ASAP on the defense of "I'm the light night alcoholism-shock-jock funny-man. Nobody with a brain would ever take bants I make about another internet person seriously."
