No one goes to prison for that short of time. Typically state prison requires two or more years. Anything less than that or pre trial confinement would be served in jail.
Yeah, sorry, that's me misusing prison with jail. I think nick will be detained for a few weeks, even if that means staying in the jail for a while. I could be wrong of course but I feel like the first offender leniency will be minimal towards him and more in Kayla's favor. Particularly since Nick is part of a home schooling system where he's also in charge, in limited capacity, of other people's kids

  • Agree
Reactions: Procrastinhater
Said it before but yeah, I'm extremely confident the caller was one of the kids. You know things are down bad when you'd rather narc on your parents rather than continuing to live in a drug fueled nightmare and eating Spaghettios
It was a mandatory reporter, so undoubtedly a kid mentioned something to an adult with a legal obligation to report. Based on the timeline, the report coming on the 16th and the kids going to church the 15th it makes sense to be someone from church.

They are going to need it, psrents arrested, everyone knows and they likely won’t be able to see parents for a year.
I thought I read Kayla is released, and I'm pretty confident Nick will make bond, so there's nothing physically prevent them from at least seeing their kids but yeah, it's going to be a chaotic time ahead for the kids.

I guess it won't be cheap either, damn what a massive plummet from grace.
Eric July said he’d pay for it supposedly.

Even if not, Nick has the money to cover it.

But dealing with this and Monty and rehab. Things are going to get strained.

Nick should really settle with Monty or asked if everything can be paused till he’s unfucked. Prefferabely settle.

Oh he's super fucked, the bad part is I assume they will probably lose custody of their kids which is fucked up.
Then he will have to battle to get his kids back dark times for the Rekieta household, how do you fuck up so hard man Sheesh.
Nick and Kayla will be given every opportunity for counseling and rehab as first time offenders with kids. What they choose to do with those opportunities is up to them. It took two years for my buddy to get sole custody of his kids after his ex turned junkie. He may have been able to go harder, I wanted him to, but his attorney advised a slow approach of letting her hang herself since she never bothered to see the kids anyway.

You're missing members of the clergy.

It's technically unconstitutional and has been challenged by the LDS, but in MN clergy are still mandatory reporters when they learn of child abuse through ministerial duties.
  • Others: LEOs, probation services staff, clergy, youth program staff, guardians "ad item"
Clergy wasn't a separate category for some reason

I know nobody ever goes to prison, but if there were a poll I would put my vote on Nick going to prison for no more than 90 days. Both mom and dad getting wrapped up in possession charges with a firearm enhancement is too big a deal for a presumably small town community. The kids were picked up by the grandparents and it's the start of summer vacation. I could see the courts having Nick serve the summer with Kayla getting a slap on the wrist/mandatory rehab over the same period.
It doesn't matter how "small the community is". What matters is if they have prior felony arrests. If they have none, they're not going to prison. They'll get probation and they'll probably have the option to get the felony expunged after completing the probation.
I don't think he can physically go cold turkey. I think people should also listen on the scanners for when the jail has to call the local hospital because nicky is going into withdrawal.
What was he hooked on?

The Sheriff's office gave me the incident report upon request:
The incident was possible child abuse:
Thank you for your service, doing Sneed's work.
The list of mandatory reporters is pretty extensive, it could have been someone at church, the homeschooling group, a doctor, a nurse, or even their dentist. Or someone who is a mandatory reporter by virtue of their profession, but interacts with the Rekietas on a personal basis.
Since some federal employees are mandatory reporters, I will place my money on it being a literal Fed, because that's funniest and I want it to be true.

There's actually a caveat that confessions ARE legally protected Chapter 595 Section 02 Subdivision 1 (c) "A member of the clergy or other minister of any religion shall not, without the consent of the party making the confession, be allowed to disclose a confession made to the member of the clergy or other minister in a professional character, in the course of discipline enjoined by the rules or practice of the religious body to which the member of the clergy or other minister belongs; nor shall a member of the clergy or other minister of any religion be examined as to any communication made to the member of the clergy or other minister by any person seeking religious or spiritual advice, aid, or comfort or advice given thereon in the course of the member of the clergy's or other minister's professional character, without the consent of the person."

And the mandatory reporting statute refers to this directly.
"employed as a member of the clergy and received the information while engaged in ministerial duties, provided that a member of the clergy is not required by this subdivision to report information that is otherwise privileged under section 595.02, subdivision 1, paragraph (c).""

Yep, and I bet that’s exactly what will happen. You know damn well those kids weren’t being taken care of, it’s impossible. Kayla alone looks like she’s been on another fucking planet for 6 months.
I bet the wheels fell off when their old nanny left. Even if both Rekietas were drunk and/or high, they used to at least have one responsible, sober adult in the house. Then the nanny left (probably because they were getting paid peanuts to take care of five kids solo) and suddenly they had to do actual parenting again.

Oh shit, so someone went to CPS as a mandatory reporter? Or CPS was required by law to forward a complaint to the authorities?
Like a doctor, or if they were in public school, a teacher. I doubt the homeschool pod qualifies as a mandatory reporter, so I'm guessing one of the children's doctors when they came in for something related to whatever the alleged neglect was.
