Nick and Kayla will be given every opportunity for counseling and rehab as first time offenders with kids. What they choose to do with those opportunities is up to them. It took two years for my buddy to get sole custody of his kids after his ex turned junkie. He may have been able to go harder, I wanted him to, but his attorney advised a slow approach of letting her hang herself since she never bothered to see the kids anyway.

I know nobody ever goes to prison, but if there were a poll I would put my vote on Nick going to prison for no more than 90 days. Both mom and dad getting wrapped up in possession charges with a firearm enhancement is too big a deal for a presumably small town community. The kids were picked up by the grandparents and it's the start of summer vacation. I could see the courts having Nick serve the summer with Kayla getting a slap on the wrist/mandatory rehab over the same period.

It doesn't matter how "small the community is". What matters is if they have prior felony arrests. If they have none, they're not going to prison. They'll get probation and they'll probably have the option to get the felony expunged after completing the probation.

I don't think he can physically go cold turkey. I think people should also listen on the scanners for when the jail has to call the local hospital because nicky is going into withdrawal.

The list of mandatory reporters is pretty extensive, it could have been someone at church, the homeschooling group, a doctor, a nurse, or even their dentist. Or someone who is a mandatory reporter by virtue of their profession, but interacts with the Rekietas on a personal basis.

There's actually a caveat that confessions ARE legally protected Chapter 595 Section 02 Subdivision 1 (c) "A member of the clergy or other minister of any religion shall not, without the consent of the party making the confession, be allowed to disclose a confession made to the member of the clergy or other minister in a professional character, in the course of discipline enjoined by the rules or practice of the religious body to which the member of the clergy or other minister belongs; nor shall a member of the clergy or other minister of any religion be examined as to any communication made to the member of the clergy or other minister by any person seeking religious or spiritual advice, aid, or comfort or advice given thereon in the course of the member of the clergy's or other minister's professional character, without the consent of the person."

And the mandatory reporting statute refers to this directly.
"employed as a member of the clergy and received the information while engaged in ministerial duties, provided that a member of the clergy is not required by this subdivision to report information that is otherwise privileged under section 595.02, subdivision 1, paragraph (c).""
