I can get what Jobst is trying to do with the misinformation about lawsuits in his Discord chat - make fake tantilizing bait for the sites and content creators who are gleefully reading the messages leaking from said Discord and reporting on it.

I would have to say, making up a non-existent lawsuit as a content creator who's reputation and view count are in tatters because many of his fans felt that you misled them about the existence/nature of an existing lawsuit is a fucking bold strategy. By which I mean it's absolutely retarded and you are playing with matches and gasoline around what little remains of your credibility.

Then again, Jobst is the type of guy who is so "smart" he believed AI when he fed court transcripts into it and the output told him nope no possible way you could lose your defamation case...

Unless closing the Discord is "delete the server and maybe start anew" , it probably wouldn't work.

Closing the existing Discord to a private server with no open invitations would prevent new people from joining, but it wouldn't prevent anybody who is already in there from continuing to screenshot and leak messages. It would effectively be closing the door to the henhouse when foxes are already inside. And depending on the size of the Discord, it may be very hard (or practically) impossible to tell who is leaking the messages, unless Jobst were to move these conversations into extremely small private channels. (I have no idea how many people are in Jobst's Discord, and I have zero interest in joining it to find out.)

In terms of closing the Discord to private and going "positive vibes only UwU" and shutting down all conversation about the Billy lawsuits, the judgment against him, other YouTubers making unflattering videos against Jobst and making it a complete hugbox circlejerk about how great Jobst and his content is, no dissent against Dear Leader or you'll be banned, I would bet a decent amount of money that Jobst is not capable of this. His ego is too big, and to Jobst, he believes lost the lawsuit to Billy on Apollo Legend on an unforeseeable technicality.

It's very likely that the only reason he even lost this lawsuit was because he refused to keep his mouth shut even at the advice of his lawyers. It's a defamation case yet he kept trying to defame Billy with multiple videos and posts.

Saying "fuck lawyers" is not a good idea because your case is going to be decided by a judge and most judges happen to be former lawyers so "fuck lawyers" won't sit well for them. On top of that if you try to make the case mostly about how someone supposedly cheated at Donkey Kong the boomer judge probably won't care. When Billy Mitchell and his lawyers come in and say "this guy lied about how I caused a guy to commit suicide" that will get the judge's attention. On one hand Billy is talking about how a guy straight out fucking died and you're talking about how MAME emulation means Billy technically cheated at Donkey Kong.

Sorry Karl but the judge is probably going to pay more attention to a guy fucking dying than about accusations of emulation that he probably can't understand.

I've enjoyed the story arc since the beginning. But I do wonder where it ends. Karl either continues slogging on through life to pay back Billy, with all the strain that has on his relationship and family. Losing EVERYTHING will probably be the end for him. Being alone and just gaming, making slop fomo ad based videos to pay Billy will only drive him deeper into despair. How long will he have to keep paying to pay Billy up fully? I haven't crunched the numbers. Will his dwindling YouTube videos help him live and pay his bills and billy debts? Or would he have to go work at McDonald's?

I don't see any future for this guy. Only despair and early death. And I've said before that it's deserved. Not just for making Billy slander vids, but for actively contributing to the death of a fellow human himself, and projecting it falsely onto someone else.

Sorry Karl but the judge is probably going to pay more attention to a guy fucking dying than about accusations of emulation that he probably can't understand.

Judges are actually often surprisingly fair and adept to take a technical analysis in applying them to technology, even at old age. Different country, but US District Court Judge William Alsup was in his sixties/seventies for the Oracle v. Google case and learned basic Java programming because he wanted to understand the legal arguments both sides made better in order to rule fairly.

Back to Jobst - rather than make a wall of text the judgment is here.

Paragraph 421, the judge finds that says that "Mr Mitchell did have a reputation as a person who had cheated and had used litigation in the manner alleged by Mr Jobst; but [...] the imputations about which Mr Mitchell complains have in fact caused significant harm to him personally and to his reputation – harm that outweighs his pre-existing reputation and the contextual imputations"

The judge knew enough to say that (in essence) that Jobst's attorneys proved that Billy had a reputation for being a cheater and that reputation pre-existed Jobst making video content on it, and that Billy settling with Twin Galaxies didn't change that. He sided against Jobst on what anyone with basic empathy and common sense could tell you, that being accused of and defamed for being responsible for the death of another person is way worse and more damaging to your reputation than any harm you have for being known as a guy that cheated at arcade games.

So the judge did consider the accusations of Billy cheating to the extent they were legally relevant to this case- not on whether they were true or false (because Billy didn't sue Jobst over Jobst calling him a cheater), but only to the extent they applied to Jobst somehow believing that being known as an arcade cheater (which Billy had been known for thanks to Twin Galaxies already) is a far greater sin than being known for driving someone to kill themselves.

Turns out ignoring your lawyers and not shutting the fuck up to let them provide you the best possible legal defense is a pants on head retarded idea. Who knew!
