I’m always guilty of applying my human logic to the legal system but it seems to me if lawyers have an obligation to quickly communicate settlement offers to their clients then the judge has an obligation not to sit on this with his gavel up his ass and instead he should quickly rule the email is not attorney eyes only.

As much as I personally agree, both the district and magistrate judge have many other cases that are actually proceeding and where they consider the stakes to be higher. E.g., serious criminal trials. Either judge could very easily fix this all immediately if they had the will to do so. But they made a strategic choice early on—years ago—that this eternal pretrial litigation is not their most important case.

They're not really following the case like we are, but I understand the mechanics of what their chambers may look like on a daily basis. Hell, they probably expect rational people to settle these types of things at this point, but both litigants happen to be acting irrationally. They're not expecting Russell Greer to actually make it to trial. Can you imagine him doing jury selection and spending a day actually directing a trial? His emails and frivolous statements about criminal and non-copyright matters are not relevant to his claim. He can't talk about these things in this way at an actual trial in a judge's courtroom. His greatest embarrassment would be showing up to do an actual trial.

He has yet to really correctly comply with simple instructions once in the suit though. The thing that truly makes him a citizen is missing. I believe the defense should add a sort of cryptozooligist to their witness list to proffer real testimony that Russell Greer cannot possibly be a citizen of the United States of America, because he is a strange cryptid with inadequate documentation. I think an affirmative defense that Russell Greer is not a US citizen by virtue of being a literate hominid cryptid is appropriate. I don't mean it in a bad way. He refuses to settle in order to vindicate his rights. The courts just don't think that's rational when he could theoretically settle. It's economically irrational but not wrong.
