In my opinion, if the bodycam footage was attached as an exhibit to a motion and filed in the court after the commencement of criminal proceedings I would say that definitely counts as evidence. The statute merely says "presented as evidence in court" and makes no mention of what stage of the proceedings it has to be nor does it specify that it has to be admitted to be shown to a jury at trial.

It could be a few different reasons, and it might not have anything to do with Nick
it most likely has to do with nick. there's no other reason not to release it other than nick's screeching and, presumably, threatening to sue the county if it is released. the idea that it would showcase police misbehavior and make the county look bad is not likely, i don't think. he's already claimed that releasing it would be a violation of his constitutional rights, which suggests to me he believes that he has a case and the state might not want to deal with it.

nick is effectively saying, "look, you convicted and sentenced me based on the evidence which did not include the bodycam, and i haven't even been found guilty yet, so to release the bodycam footage would be a gross violation of my privacy and inflict needless suffering on my family. it would be perceived as vindictive and retaliatory and a clear violation of my constitutional rights."

what's weird to me is that this increases the chances of two court battles instead of just one, unless they're extremely confident they will beat null. if null wins and the bodycam gets released and nick sues in response, the state has to fight two legal battles. but if they just released it, they would only have to worry about fighting nick in court, and they would be more likely to win. this amendment also makes the fight against nick more costly since it offers a strong argument against releasing the bodycam, which nick would definitely point to if he sues the county after its release.

make no mistake, this is strong move designed to keep the bodycam from getting out presumably because nick has been screeching about it, but it does guarantee a bigger fight with nick if it comes out.

The county seems keen to block the bodycams which seems like good news for him unless I'm misunderstanding something.
Because they're punching above their weight class with no authority to do so and he knows it.

Divorce is all "no-fault" nowadays, so the only thing "fault" dictates these days in court is who gets custody, child support and alimony, and how much of each. Nick obviously doesn't care about his kids anyway, so all he's worried about is getting saddled with monthly payments before he rides his new toy off into the sunset.
I think the only reason Nick hasn’t divorced Kayla is either his parents threatened to cut him off or he spoke with a divorce attorney and found out he’d get fucked in family court.
The house is in a trust. She ain't getting it in a divorce, at least not all of it. He is also dirt poor. A divorce if he was still a successful streamer is different to someone who couldn't pay their very low mortgage without selling another house.
I believe Nick and Kayla owned the original house that's now sold. The house they currently live in is owned by a Rekieta family trust, I think held in the interests of the children. I bet they'd leave Kayla in the house with the kids if that was how they divided custody. But she'd never be able to sell it.

I do think it's odd that Nick's family bought the house and put it in a trust rather than just giving it to Nick and Kayla. I wonder why? Tax purposes or because they didn't trust Nick and/or Kayla?
If things get ugly, a prenup is only as good as the lawyer(s) defending it, and as weak as the lawyer(s) attacking it, modified by how much the judge hates either party.
With the trust fund things get a bit more complicated because the court can finagle and work around the trust agreement to siphon both assets and money directly to the children or even to Discolored Streetmeat in some cases, especially since she is a long term stay at home mother without any real employment history or resources of her own.

I think another big thing is that the state has already looked at the issue and ruled that the body cam footage is in fact "evidence presented in court" if the county prosecutor is trying to now get what is effectively a declarative judgement on a matter that's already been decided I'd think there may be some issue preclusion/res judicata/collateral attack issues as well.
