The only wrinkle in this road to absolution was that Monty couldn't afford to pay the massive amount that would have been awarded against him, thus Nick had to spend well over 500k (approximately 10k KNUs) and destroy his life by getting arrested for felony cocaine possession and child abuse to delay the trial until Monty's lawyers decided that Nick had had enough punishment and the case wasn't worth it anymore and dropped it instead. Certainly a galaxy (gas) brain strategy if I've ever seen one.

Looks like he's going with #2. Which is, of course, the more disgusting of the two.

The belief that Monty ran out of money isn't a cope, or just taking Monty at his word. It is supported by the evidence. Chief amongst that evidence is the fact Monty only got about $3,000 or so since the Nick lost his appeal (which triggered the Cokestream). We actually don't know if Monty had pro bono representation. A popular theory here was that Schneider was working at a deeply discounted rate, but that's just the usual thread speculation. Nick himself said that he thought Schneider was working on contingency, but Nick's opinion means even less than anyone here.

What we know is that, when it came to the appeal, Monty had to raise money to bring in a guy that specializes in appeals (meaning that very definately wasn't pro bono). He out-raised Nick... and then... beat Randazza with a much cheaper lawyer. Cue Cokestream.

It would actually be pretty funny if Monty's total outlay for this whole thing is pretty insignificant and, in return, he caused Nick to burn hundreds of thousands of dollars, and get so fucked up on coke on a livestream that the 5-0 noticed and included it in a search warrant application. It would still be a Nick W against Monty, I suppose, but a really pyrrhic one.

It also makes one wonder what would ever happen if Nick pissed off somebody with less baggage but more money.

Didn’t he have to sell one of his homes to pay for the lawsuit? Nick did not get away lightly with his criminal slander of Monotograph.
