Funimation Audio Leaks - Sacred Ointment memes for degenerate teens

Nobody likes their property being taken. Trademarks are things you have to defend. Toei isn't stupid. Letting people run around using your brand for profit or otherwise can be harmful to your ownership of said brand.

Failing to defend a copyright or trademark could impair your rights to it. Here'a s story to illustrate.

Little League Baseball teams love to use Major League Baseball team names, complete with the branded hat. The kids love it. The parents love it. Who wouldn't love it?

Answer: Lawyers at MLB. They couldn't simply ignore this. But they don't want to poison the well with current and (ideally future) fans, nor do they want the PR nightmare of suing Little League Baseball. Little kids showing up to baseball games in the hats & uniforms of their counterparts at baseball games is a Marketing 101 Win.

How to avoid the problem? Charge a nominal fee to use MLB-trademarked team names and logos. It's a fraction of what they would charge anyone else to use it. But they found a way to defend their copyright and trademarks.

Funimation has fired Vic. The risk of hiring him back is greater than simply writing him a check. And Funimation's future with Toei is uncertain after the lid of that cesspool has been lifted.

Wouldn't it be a kick for Toei to sign with another studio, and add one little proviso about which Voice Actor they prefer for Broly?

All this backstabbing by the other VA's who conspired because they were jealous of Vic's success as Broly, and at the end of the day, they're all out, and he's the last man standing.

The longer this goes on, the higher the settlement. Not just dollars, either. Vic needs more than just dollars and no admission of wrong-doing. He should be looking for exoneration. Ask for lower money, but an admission that their investigation was flawed and counting on unreliable sources resulting in a rush to judgment. That gives the all-clear for someone else to hire him. And it may be a bitter pill for Funimation, but they have a much bigger battle on the horizon with Toei. They could perhaps even leverage the settlement with Toei and explain they are no longer letting the toddlers run the daycare there. Not an easy sell, but possible.

I'm baffled that Fukunaga was so stupid to take legal advice from non-lawyers AND that his own legal team expected this to be a slam-dunk (Perhaps I'm giving him too much credit he was smart enough to confirm this advice - I've been wrong about Funimation's collective IQ repeatedly)

I've always speculated that Funimation would be the first to settle because they have the most to lose.
Now they have a scapegoat which they can offer up to mitigate the assfucking they'll have to take - Chris Sabat.

Too bad it seems to be run by idiots who suck Chris's cock. Gen apparently thinks the TCPA legalized defamation and tortious interference, and I highly doubt the people he handed Funi off to have any more of a clue.
 
I don't fully understand their reasoning, but I do know that they're unbelievably paranoid about it, and haven't learned the DRM lessons that western companies have. I suspect that doujin is something they look the other way about simply because they always have done so, and so it's tradition to do so. People misinterpret it to be an understanding of how it bolsters fan support, but their behavior elsewhere shows otherwise. Toei gets Big Mad about DBZA, despite much of the time they were out for blood it was very much a parody of an old property that hadn't been running for like a decade (DBZA predates Kai).
There's several reasons Japanese companies tend to look the other way when it comes to doujins.

For one, they are strictly limited printings. This has obviously changed a bit with the advent of the internet and scans, but even then artists make disclaimers that it's not mean for redistribution. Another is that they make little to no money from doujins, a successful doujin is one in which you get the money back for print costs. Doujins are also a breeding ground for new talent. Let's just use Dragon Ball as an example. Dragon Ball Super manga, Dragon Ball SD manga, and the Yamcha reincarnation manga are all made by doujin artists that went professional. The latter Yamcha artists even used his fan artist pseudonym as he was that well known and popular. And lastly, what I think is the biggest difference is that outside of the use of the property, doujins are wholly original work as in they aren't manga panels or anime footage repurposed. I also imagine the fact that DBZA is made by foreigners also plays into it. But even Japanese "parodies" can be subject to scrutiny by rights holders in Japan.

It's not even like Japanese companies always turn a blind eye to doujins. There was a pretty notorious Pokemon doujin that involved beastiality. And it had gained so much notoriety that either Nintendo/Pokemon company sent a cease and desist to the artist to prevent further works.

I would also think Toei would disagree with your perception of DBZ as a property. Even as soon as GT stopped airing in Japan in 1996, various other countries are starting to air DBZ, notably the United States would do so. This sparks various new pieces of merchandise with Toei's property from toys to dvds to video games. In 2008 when DBZA starts to be posted, Japan is still releasing DB onto DVD for the first time.

Given how much Toei hates DBZA, these leaks should get Funimation into some shit with them. But I think if what Nick says is true and that they are receiving money for DBZA that will likely be the bigger issue.
 
So, on Friday, the plaintiffs and the defendants will argue their points in front of a judge. At that point, the judge has up to 30 days to make a ruling on the motions to dismiss.

BHBH's motion was pretty convincing. It was direct, cited relevant law, and made a prima facie case for its arguments. In addition, the motions to strike were good, I've read through them a few times and believe they were right on the nose.

Question: what are the chances these recording sway the judge one way or the other? Could BHBH play them in court, to make the case about a sexualized work environment? Could news about the recordings make its way to the judge in some other fashion?

Just feels like these could be the straw that broke the camel's back when it comes to Funimation. It's clear they have different sets of standards and speaks to a clique.

Is that a report of how actual Japanese people are talking/feeling about these recordings, or merely their guess for how he thinks they’re feeling?

I’m really hoping it’s the former, so that some form of response from Toei will be inevitable.
