Wasn't Lemwah basically arguing that his clients are a platform ? 230 applies to social networks themselves, people who actually post there can still be liable, it's just that Twitter and such are themselves absolved of any responsibility as platforms, as opposed to publishers, in which case different standards would apply.
If judge agrees with this argument, then he really is a boomer. Or I'm just super exceptional and understand this wrong.

I'm actually amazed the TI was dropped and defamation stayed in. I always thought the defamation causes were the ones likely to be dropped with the TI causes being the strongest.

For the Ron TI drop, I'm more surprised, it sounded like Chupp dropped it because Ron only did one instance of TI and that somehow isn't enough since it only happened to one con?

I don't understand how strong monetary damage can be calculated from defamation without the TI since his business prospects were interfered with. Is that mostly a jury thing where it is punitive only?

The Judge didn't agree, he asked him sarcastically if retweeting means that he's absolved of responsibility
 
The impression relayed of Chupp from the initial hearing (whether to depo before or after TCPA) was that he was a no nonsense, cut straight to the bone guy. This seems to still be the case. Ty was late with some important evidence, so Chupp seems to have chucked it (evidence that would have strongly supported TI).

We'll see if Nick's admonition of, "The judge may seem hard in court and then rule in your favor" bears fruit in 30 days (or less).

Now Chupp may have opened a wide appeal door for Vic based on the reports of the evidence standard requested, but that's moot until the rest is decided.

Well, my hot take on the TI dismissal was correct, even though we didn't get confirmation from Nick until some minutes after I made said hot take.

I was at the hearing. I am not KickVic or IStandWithVic, just curious how a case like this plays out. However, feel free not to trust some anonymous newfag (and apparently not the only one joining for this thread).

It'll take time for me to read the thread from the start. Before then, what are the remaining open questions people have as to what happened? I can provide facts and impressions, but would prefer to avoid anything too speculative.
Did Ty actually seem to be fumbling before the Judge?

Was the judge covering his face and getting exasperated with counsel?

I sort of disagree with this. Almost everybody believes/has done SOMETHING stupid and shitty. There's a difference in degree, to be sure, but if you're only willing to be entertained by perfect people, you're never going to be entertained at all.
 
For now, it seems those "fuckheads" on twitter were in the right - but then who knows maybe Chupp will go Judge Dredd on the defamation claims and the case goes forward.

PS: Legal lads -> does this mean that Lemoine can finally claim he "won" a TCPA?

I'm not a legal lad, but TCPA is still undetermined since defamation and conspiracy are still on. Fuher can't invade Poland yet.

I am still trying to wrap my head around how the defamation got through but not the TI.

Unless he actually threw out the declarations supporting it, it sounds like a reckless, half-assed decision during the hearing which will reflect badly on it if there is an appeal.
