That and yes this does fall on Ty as head boss. Prep or lack of it falls on him. And right now he's seeing the fallout of thinking you got this. Always apply human factor in life. Also understand you can never prepare fully for the human factor, just got to be on the bounce for it.

I am still very content that defamation and civil conspiracy is still on the table, defamation and civil conspiracy were supposed to be the most difficult to prove. Everyone keeps mentioning context and not the actual evidence that is already out there.

So what I'm getting is that Ty Beard is back to square one with a barebones case to work with that isn't completely gone. This really just sounds like he didn't make a compelling enough case. Chupp is a normie and likely hasn't been following the story. He's probably stuck back at the January and February timeline.

It's quite interesting actually. If that's the case and it gets to move forward with whatever they have left, Chupp will get to see the story unfold from the beginning with all of the details ironed out with the appeals.

This makes for great journalism, I'm excited for Season 2. 🍷
 
I do have a quick question, though: Who walked out the most angry besides Chupp, Nick or Monica? Someone (think it was HerExcellency?) said Monica walked out in a bad mood, probably because she and Ron had expected it to end today, but it's still on-going and whatever plans they had in mind have been ruined.
 
I expected this thing to be a crucible for lolcows, and it did not disappoint. Anything else, legal or otherwise is gravy.

The problem is that a lot of people were supporting this movement for a long time and are following these events very closely.

I unfortunately also fit that bill but after a while passed to let the news sink in, I feel as though Vic at least got room to fight back instead of laying there to take it.

Though for me, Weeb Wars, like gamergate and Comicsgate, could have been an opportunity to support indies and third party people so Funimation and sony won't get a dime out of customers.

It seems as though people would rather spend more of their energy sperging out than going on a goddamn search engine and look for "anime importers that are not funimation" instead.

I understand and I agree. But that is an issue every time a particular lawsuit becomes a "political event". In the mind of the audience it's not a lawsuit anymore, it's a battle or their little retarded cultural war. And of course you can't change that, but people will have unrealistic expectations.

In the end, whatever gets decided, this is not gonna be a victory for "cancel culture", or a victory for "all those innocent people who got fucked over #MeToo/by SJWs". In the end, some of the plaintiff's causes will be granted in a defamation/TI lawsuit, or none. Nothing more.

That's why I can't stand Rekieta and all the crabs surrounding this lawsuit, propping this shit up as GG3.0, impressing impressionable NEETs, and taking some of their money. What's more infuriating is that many of the people in here seem to fall for this shit again.

I think it is absolutely optimistic to assume anything other than that Chupp doesn't want to hear the full story after today's, well, dumpster fire. He is probably looking for any excuse to TCPA out the rest of it in his written judgment.

If everyone walks out happy then there's a fucking problem, if everyone walked out pissed then it went the right way.

Doesn't really imbue confidence though does it? "keep donating to the GFM guys, Ty promises he'll not coast this time". Makes all the talk about "going above and beyond for my clients" and "I won't let them destroy your son" seem a bit more like fart huffing and wolf tickets when it seems like he did what he thought would be enough to get past a TCPA hearing. Being overprepared for one is better than getting blindsided by an anal judge who has decided to run it more akin to a trial than a hearing. Ty and his team are probably only 35% to blame for the the goofs of today but as we've seen its going to blow up big with the waifu pillow huggers who thought he was some sort of lawyer John Wayne who was going to walk in there and slaughter all the defendant's defenses.

Ty lost the case for real this time and appears to be a meme lawyer.

Judge threw out the amended pleading and threw Ty off.
TI dismissed for everybody.

Defamation and Civil Conspiracy will be decided in within 30 days. Speculation is Chupp has already made up his mind and is taking the time to frame it so it's appeal proof.

after reflecting a bit I’m ready to offer my two cents; the situation is nowhere near as hopeless as some spergs on both sides of the aislemake it out to be

Here are the facts

Vic and his legal team still have five cases left

The cases against Jamie Marchie was regarded as the weakest one so losing those isn’t that big of a deal to the point that I think appealing those would be a waste of time

The charges against the MoRons and Funi that were thrown out are a bit of a setback but they will most likely be repealed hopefully rendering KV’s small victory pointless

Apparently Ty didn’t do that bad at the trial according to a couple of witnesses who posted here. While he definitely fumbled in some areas he was strong in others

Some of the reasoning the judge used to dismiss the cases is shakey

Ty was unprepared for the way the judge operated so hopefully he’ll be more prepared next time

Kickvic is are giving each other asspats. They’ve somehow grown even more arrogant then they already are. And the more arrogant someone is the more likely and frequent the mistakes will be

Everyone still hates kickvic and funimation

KV continue to act like clowns

Chris Sabat and Ron Toye have had their true faces exposed which has the added effect of showing KV’s hypocrisy

The funimation audio leaks will likely cause funimation problems with Toei

The court of public opinion is on ISWV’s side

All in all this was definitely a setback but ultimately an unimportant one in the grand scheme of things.
 
Okay, new poster here but I need to shoot down some things being said here.

1. Ty hasn't been "trying to coast by on the bare minimum". Ty was preparing to prepare PRIMA FACIE evidence. That's what is expected in a TCPA. And not only did Chupp expect more evidence, but he ignored evidence that was presented, which shouldn't even have needed to be. For instance, he wanted monetary values for the losses, and that was literally in the Vic affidavit/unsworn statements. It was the judge who decided to just simply ignore evidence? That's on the judge. He had *30 more days* to make final decisions, but he decided to do them today.
2. Judge Chump is a complete idiot. He is a public figure because there were people in the room? It's ridiculous.
 
There are folks in this thread that are going balls to the wall "SKY IS FALLING" and people are hand wringing like it's the end of the goddamn world.

For those of you that think this one single solitary court appearance is the end: It's not, this isn't Law and Fucking Order on TV, these cases go on and on and on.

This is a goddamn campaign and not a some silly lil one and done battle.

Think of it as this is the first time both sides have met in war and , like the old saying goes, once the enemy is met all battle plans go out the window. Neither LemonJello nor EmperorTy knew what to make of Chupp and that's what cost both sides heavily. Some things worked out, others didn't, in the end the court proceeding will go on as they must.

Which makes the locking of the threads both extremely fucking exceptional.
