If a lawyer losing his license to practice is called "disbarring", is a judge losing his license to practice called "disrobing"?

No it's impeachment - which I gather is almost impossible - or retirement. Judges don't really get punished or messed with, they just get appealed or overruled.

I'd understand the sentiment, to be sure, but those are inherently things he does off the clock.


I agree, but there's still something to be said about not giving any quarter for damaging scrutiny. The missed deadline hurt Ty, but it didn't hurt Ty.

Basically it's more of an image issue than anything else. Thus, I don't really agree with the idea that Vic should suddenly be hot with Ty. It sucks how it went, but Ty got pretty railroaded there. Whether or not it's actually able to be appealed, it ultimately was a result of Chupp's discretion, rather than Ty failing. He met his burden, Chupp just raised the burden higher than it's meant to be.
 
I maintain that the missed deadline doesn't actually matter all that much, because even the amended petition lacked what Chupp arbitrarily decided it needed. At best, maybe he wouldn't have outright dismissed Jaime's involvement, but that seems unlikely given he just dismissed the idea of anyone but Ron and Monica being involved in conspiracy, and the crux of Jaime's involvement is the conspiracy. It's an excuse for people to blame Ty over, but transcripts so far seem to indicate Chupp made sweeping decisions and demanded a higher standard of evidence than he should have.
I agree wholeheartedly that Chupp was gonna be Chupp no matter what Ty presented. Ty could have been the bastard child of Atticus Finch, Perry Mason, Matlock and Phoenix Wright combined and the outcome yesterday would have still been the same. Chupp is a joke of a judge and there's no changing that especially when we look at the previous Texas Supreme Court opinions people have posted above. In light of that, I''m not concerned about what Chupp thinks, but rather what a panel of appellate judges are going to think when they consider the record. And unfortunately, when you do stuff like miss deadlines, that gives the appellate court room to excuse some of Chupp's fuck-ups by saying he acted within his "discretion." The appellate court might look at the record and say "Yeah, we agree that the stuff in the amended petition would've been sufficient for TCPA, but it was filed outside the agreed upon deadline imposed and therefore it was ultimately within the trial court's discretion to consider it. We find that the trial court did not abuse its discretion."

There's been so many amendments that I can't actually tell with certainty what was actually valid evidence at yesterday's hearing.

Regardless of what the discarded amendments had, Chupp's seemingly astronomical standard is grounds to appeal alone. Doubt Marchi is out of the woods yet.

To be fair to Ty, if Chupp was being so arbitrary and acting upon his own moral compass than the letter of the law, it's no surprise that Ty couldn't make a coherent argument.

As Vic, I wouldn't be asking him to spend every hour working at the job . However, I would be pretty irritated if I found out my lawyer was missing deadlines and needing to file amended filings to compensate for missing said deadlines when he is simultaneously shooting the shit and meming with people on twitter. 😕

As someone else said above, it wouldn't have mattered in the end as far as Chupp was concerned, but Ty would at least be going into appeal with a much better record for the COA to consider.
Do we even know the lateness was related to Ty's spent hours. They could have been late because employee X thought they compiled the report but didn't convert it to the correct format. They went away for the weekend. Employee Y worked on converting it but didn't know what they were doing. You can still blame BHBH or maybe Ty specifically but Ty's time may have had nothing to do with it. We don't know the details. But In the last days I imagine there's a good bet Ty has little to do with it and it's in staff's hands for the most part.

While I absolutely believe they need to appeal everything they can, and they have good cause to do so because some of this ruling makes no damn sense, BHBH committed some unforced errors that seem rather unbecoming of a firm that is purported to have an extensive roster of high-dollar clients.
 
Vic will have to pay for her lawyer. It's part of the TCPA.

But she is still fucked. So is Monica. They will end up quietly Asteriosed when its time to renew their contracts with Funimation.

You don't keep around employees that get you dragged into a lawsuit.
Again, it seems the employees are Sabat and his friends. Sometimes the bad guy wins and the canon ending is a downer.
Asterios got fucked because NY Anti-SLAPP laws are significantly weaker than TX's, so because his case went to trial, he had to take on personal debt to pay all lawyer fees+costs out of his pocket even though he won (plus he lost his job as a result, which doubly hurts).

Pending appeal, Marchi will have all her legal costs paid by Vic, plus court-imposed sanctions that will probably be determined at a separate hearing. The same goes for any dismissed-at-pretrial charge (so Toye TI, Monica TI, Funi TI..etc are all counted as separate charges each with their own sanction). If the GoFundMe runs out, he will still owe money to Ty as part of whatever legal representation agreement.

Even if Vic wins on his remaining charges, he could still end up losing money on the whole thing, especially if he appeals and fails (because appeals will add even more billable hours etc).

TL;DR: Vic could be in for a world of hurt, even if he wins on whatever remains of his cases.

They did commit some errors for whatever reason that may be, but had Chupp not ruled the way he did, no one but maybe kickvic would really care that much about them. Even with the ruling as it was, their errors had no real impact on the decision, because the decision came from bizarre reasoning instead of things like sanctions for late filing/notary stamp issues.

The outcome of the hearing aside, it sure would've been sweet had everything worked out yesterday and Chupp ruled in the opposite fashion. The meltdown law twitter would have been having and the aneurysm the bald headed buffoon would have going through and the constant spin from the usual suspects would've been hilarious. 😂

if Chupp had ruled for the immediate execution of all the defendants, lawtwitter would be screaming about how Chupp is an incompetent white dude and no one should be smug about this, because this is such an OBVIOUS appeal case. That's been predicted for months. I believe Nick also said that if things went this way (or worse, with a complete dismissal), they planned on appealing anyway. Basically, anyone expecting the hearing to be final and not involve appeal regardless of the decision was being overly optimistic.
 
What up guys. Been busy yesterday, and finally got around to see whats been going on. It seems it hasn't been favorable for ISWV. But from what I'm seeing, it's not over yet. Seems to be at a 60/40 phase, and there are appeals. It's rather disappointing to see some people go crazy, give up instantly, or even switch sides from this hearing, but I guess that's what separates the faggots, from the cooler heads. Keep in mind there are people who lost badly at first in cases, but later won through appeals. Not saying it's guaranteed here, but there's hope, and a chance. Again, this isn't over. There's also defamation, and civil conspiracy as well. Some are saying those will be dismissed by the Judge as well, but honestly, who knows, right? We might be suprised. Don't listen to Law Twitter, or some other trolling faggots. Keep cool, and enjoy your life, and everything will go the way if it's intended that way by forces beyond our control.
