In the article DoJ refers to VAWA(Pub. L. 103-322), 18 U.S.C. § 2261A, 18 U.S.C. § 2262. This fails because:
1. VAWA directs the federal government to stop stalking, but does not create any laws for it. The only stalking-relating amendments it introduced was that a court order could prevent stalking(this relies on pre-existing law)
2. 18 U.S.C. § 2261A fails for a huge long lists of reasons I explained here, when Melinda Scott tried using the same argument.
3. 18 U.S.C. § 2262 fails because none of us are violating a protection order, and for same reasons 18 U.S.C. § 2261A fails.
