I do not pay very much attention to this place, as the drama for which it is most notorious sounds painfully uninteresting to me. I literally stopped coming here for over a year because during the period where the farms were taken down I realized that I wasn't missing not knowing the latest drama on the couple of attention whores I do find... less painfully uninteresting... and didn't bother seeing if it ever came back up.
Funnily enough, the thing that brought me back was seeing it mentioned in a DMCA and figuring the URL was probably good.

The title was not the sole source of his commentary. Akilah's video was over 10 minutes and he edited that down to under 2. Sargon prevailed because of the title + editing + his video wasn't a replacement for Akilah's. No one wanting to watch Akilah and her content would go to Sargon's channel and find that video an acceptable substitute for hers.

The post in question on the farms appears to have copied the entirety of a livestream in the typical archive everything approach. This is the extent of the commentary, so you'd have to argue that the thread itself is doing the heavy lifting in regards to fair use. Did the poster really need to copy the entirely of the livestream, almost 70 minutes worth of material to comment on the cuts on his face?

This livestream is available on Acerthorn's channel as members only content that people have to pay to watch. The market for that video is non existant, Acerthorn reported he makes less than $50 per month from YouTube, but the copy on the farms acts as a replacement.

Even if you had a bunch of money to burn and wanted to test the limits of fair use, I don't know if you pick a fight over this.

Yeah, you're probably right. The post was definitely less transformative than Sargon's video. I'm pretty sure Hardin would raise the exact same defense if things proceeded to a defensive litigation because Josh treated the post with as much reverence as the queen keffal's fart throne video. That and any litigation where KF is involved is always an uphill battle.

If anything, my take-away is we need to make sure to add as much critical commentary to any copyrighted lolcow work posted here. I think, at the end of the day, we agree that Josh should only fight the legal battles that are absolutely necessary. I'll just defer to Josh/Hardin on whether or not the juice of this particular legal battle is worth the squeeze.

As much as I would love to see Stabbin's shivved to death in the streets by a pack of melinated individuals... as others have said, you're already involved in multiple cases, and in a sense it rewards cow tipping.

I do miss the old school E/N forums, so I do like this place and wouldn't want to see it taken down again.

But I don't care enough to go digging through the site's old legal drama for my own entertainment because most of it seems to be mentally-ill-men-adjacent and I'm usually suffering from enough troon exhaustion from everywhere else on the internet.

The legal fund should be narrow in scope in my opinion (as a donator but it’s no longer my money). The easiest and biggest wins against those who are silencing the farms.
