Why don't they just block offending websites themselves? This seems like a backwards way to go about it.
Because if the UK blocks a site directly, it looks tyrannical. But if they force the site to change under 'safety' laws, they can blame the platform for noncompliance and justify harsher actions later both legally and publicly to protect 'muh children'.
It's indirect pressure with a legal noose waiting for the naughty sites.

What counts as harmful? That's incredibly vaguely defined so it's basically anything they decide it is or anything a "protected class" or member of the government says it is.
If you want an example, hate crimes or "noncriminal hate incidents" are whenever someone feels that they're being harassed or attacked on the grounds of a protected class like race, gender identity, disability etc. Note that it just says feels that, there's no objective standard it's literally just based on if the "victim" feels it's one.

Our government is fucking insanely authoritarian and far too many clapping seals in this country when you point this out will be like "well what do you want to say that you can't hurr durr just say you want to be a cunt" or some version thereof.

From OFCOM, or Null? I'd say being them able to intimidate him into not letting UK residents access the site (with the cope that "it's for their own safety") is not the win he's trying to spin it as.

The block would come in anyway if he refused via the high courts ordering ISPs to block it on their side for UK users, like they did with the pirate bay. By blocking it on his end it also blocks it for OFCOM unless they use a proxy which means they have to VPN up themselves to even peruse this site for any 'violations' and so do the police, while British users all have at least one extra level of security.
I imagine they'll probably try and work some law to block or restrict VPNs at some point but parliament are incompetent boomers who have no idea how the Internet works, and also it takes them forever to get a bill through, by which point the loopholes will be well known

In my opinion, the correct response to this would be to unblock all British IPs and push the issue here in America. Seriously, what is the UK going to do? Try to extradite you? Heck, you might even do some general good if you can manage to be a part of establishing case law that tells the UK to fuck off with these notices to websites not hosted by them. If they want your website blocked, why can't they do it their damn selves? Because the point isn't to block the website, it's soft power bullshit. They just want you to comply. Obviously do whatever you want you know way more about this stuff than I do. just my 2 cents.

I believe that Josh @Null should sue OFCOM in the Supreme Court of the United States

Here's why:

* The move is political and meant to shut down dissent and free speech, targeting (unfairly and immorally) an innocent man who lives in a country protected by laws which allow free speech.

* OFCOM would have to prove as Defendants why they believe Josh/Kiwi Farms has committed crimes and what these crimes are. What is the evidence, where is the proof? Sources and citations please.

* OFCOM would also have to explain why they believe that the Law of England & Wales (Scotland and Northern Ireland have separate legal systems) is superior in rank to that of the United States of America, the country in which Josh lives and where the case would be heard. As far as I am aware, the national law of a country is not superseded by that of another (i.e. the Cayman Islands doesn't have a say in what Montserrat does).

* OFCOM would also have to say under oath and, at risk of further legal trouble, who told them to go after Josh. Ofcom cannot say 'this is restricted/classified information' - doing so would be akin to shooting one's foot off and I strongly doubt that any Judge would be okay with the assertion that because something is restricted in one country it has to be in another country.

* Josh/the prosecution would also be within their rights to ask why OFCOM is targeting them and not websites which openly promote drug taking, paedophilia, sexual abuse, child abuse etc. As Lee Anderson said to Jess Phillips this week 'are you part of this?'

I would be happy to chip in a few Cryptocoins for the cause, and my advice would be for Josh to build up something of a financial arsenal now and to speak with top State Lawyers about taking this case before the Supreme Court (possibly after the Summer, due to cases pending/clearing any backlogs) and for them to issue a summons.

This would scare and embarrass the shit out of OFCOM - they are the ones who are meant to do this, not the other way around, and I would personally not settle out of court for anything less than $50 million, bearing in mind Alex Jones had to pay $49.3m to the parents of a Sandy Hook shooting victim and Donald Trump was ordered to pay $83.3 million to E. Jean Carroll.

I would also reference the UK case of Belokon v Oyston as a guide - Mr. Oyston lied and made defamatory/false remarks and statements about Mr. Belokon and had to not only pay him £31m in damages, but also had to sell Blackpool Football Club as well.

I have drawer in my kitchen where I collect TV loicense demand letters, they send one every other month or so, they rotate in tone between "didunt chu knuw yu neeeeed a teevee loicense?" to "ARE INSPECTAHS R COMIN 4 U!", nothing every happens because words are meaningless in our anarcho-tyrannical system.
I can appreciate the logic behind "user protection" because everyone should be using a VPN; especially vulnerable localities like bongoloids, but anyone framing this as a proud stand is deluded.
The TV loicense shit is so funny. I literally know no one that pays it, you'd have to be a complete retard to fall for it. Do people really think the BBC will send it's Jimmy Savile task force to kick down your door because you watch Match of the Day? 😂
