I remember it being said that if it was still a misdemeanor, he'd be out of jail on the day that marked a year since he was put in jail initially. I'm assuming that's out the window now with the charge being bumped up. Which means the Grand Jury can happen in either a few days or a few months right?

If they want to keep Chris in jail, and if his only misdemeanor charge is still the Incest, they would have to have the grand jury proceeding very soon otherwise, off the top of my head, I don't know how they would keep jurisdiction over him past the 1 year mark. A grand jury proceeding would be very quick though so it's definitely doable.

Chris has been such a nuisance to the law. The Judge might give him a lenient sentence ultimately, but at this point I doubt it.

It appears the Prosecutor will be presenting the case to a Grand Jury for Felony Indictment, and the case will be moved out of Family and Juvenile Court to the big boy Circuit Court. This means Chris stays in jail. That one year rule only applied to the special Family Court which could only deal with misdemeanors.

The good news for us is Circuit Court proceedings are unlikely to be closed to the public.

The suspicion is Chris once again found a way to fuck himself. Likely by refusing a plea deal.

Chris does not lose the tugboat until he's convicted -- it doesn't matter what the charge is.

EDIT: He also doesn't lose it if he's let out within 30 days of conviction.

Contempt of court is mostly meant as a tool to get people to behave. The punishment is usually not severe unless it's flat out failure to appear. In district court they can't give more than ten days.

In CIRCUIT court I believe they can punish contempt by up to 6 months, but that's not really what it's for. You just slap the contempt charge on and cram them in jail to cool off without earning any time served (since you can just add it to the contempt charge).

Semi off topic, but theoretically could someone be jailed indefinitely by just insulting the judge and refusing to answer questions, every time they are taken back for a hearing?

Or is there a point in which the judge will just move to have them tried in absentia to get rid of them?

It all comes full circle this season of Chris Chan as Christine finally learns what it's like to be a woman.

Before everyone starts flipping out, this does NOT mean Chris is getting charged with Felonies. What this means is that the Commonwealths Attorney believes there is good cause to charge him with a felony. Therefore, the Juvenile and Domestic Relations Court is no longer the proper venue. The case is therefore being moved to the Circuit Court which is the principle judicial arm of the State and handles everything not related to petty crime and domestic disputes.

The next move will be the State actually charging him with something or an immediate plea deal. The clock is ticking right now because this has become a habeus corpus issue. They have to indict, get chris to plea to something or let him go in a speedy manor at this point. On the plus side, Virginia's circuit courts are fully open to the public so we are going to get way more info going foreword.
