If you look at the update frequency between yanderedev and mald, yanderedev is actually more productive. The only reason that I'd predict Mald's game would be released first (not that either will but I digress) is because mald's game is infinitely less ambitious.

I think you screenshoted the wrong clause, this is about somehow, a private instance being spun up while a the game is still available and counting as "competition" they did have another shitty clause about a game dev being liable for muh hate speech, though.

But back to the original point, not only SKG's on paper goal wouldnt even make this clause real (since a game has to be unavailable already in the first place),i think many of us who were playing shit back in the PS3/360 era remember how "new" MP games still made gangbusters in spite of people still playing the OG, i feel like this is a tacit admission that the only reason games are shut down is to make sure the publishers earn extra pennies from the minority who would've stayed otherwise. I think they realize that the community would be able to very easily improve most online games, since these companies fill them with hostile design to manipulate people into becoming whales and dolphins (I assume that's what they call smaller spenders). I recently played MGSV and I can tell you that the game would instantly become a lot better if you removed all of the predatory timers in the game. This probably wouldn't really affect new game sales, but never put it past the industry to worry about these things.
