I'd trust vine so far as he's not in jail. I do wonder if CGC would count him being in a group home as "in custody" since it's likely he wouldn't be allowed to leave a group home except under supervision.

Group homes are a weird area. It's not custody insofar as remanded to jail or a court ordered hospital stay in a secure area due to perceived threat, but it can be considered residential due to developmental issues and therefore not in custody.
