I guess Chris doesn't know/care that including characters from this games in his comic is blatent copyright infringement. Guess this just proves how much of a hypocrite Chris is. He'll "borrow" people's trademarks/copyrights on a whim and say the company and himself have a "silent agreement", but if someone takes his copyright shit, he flips his shit. I wonder if Hirtes is going to try and contact the developer of this game and report him so Chris will receive a cease and desist letter, shit himself and do nothing, then disregard the letter and keep infringing on people's copyrights.
Idea Factory/Compile Heart tend to be some of the more chill companies regarding fan works (they outright encourage them), as do the game companies who are represented by Maker characters (like MarvelousAQL, Broccoli, Cave, etc.), but if they get wind he's selling anything based off their properties, he very well may get himself a not so nice C&D notice.
For instance, here's a sample of how Cave handles copyright crap:
(taken from the Deathsmiles Resource RPG Maker DLC, with the material relevant to Chris' situation only included)
- Copyright notice is clearly displayed, with credits given to CAVE for creation.
- Material is not used in adult-only content.
- Material is not used in content that is promoting activities that are illegal, immoral or otherwise damaging the image of CAVE . If you are working with controversial themes, please contact us before publishing for written permission.
Most of the other companies have similar variations of the above, with the obvious proviso that if you draw it yourself, it's non-profit only. You can commission fan art for money, since you are paying the artist for a piece of fan art, but you cannot sell the fan art itself if it's based off their stuff unless they say you can, and with sole exception to things like RPG Maker or other game creation resources based off their properties (to be used in those game makers ONLY), the answer to that is generally a firm NO.
