I'm not a lawyer, but I did listen to some lawyering binaural beats, so I feel qualified to atleast posit a few points.

A continuance could be just what Chris' attorney needs to craft a viable defense. Barring medically damning evidence (IE vaginal bruising, ect.) or Chris outright spilling the beans to the cops, a good lawyer could argue away most of the other stuff in this case. Even if he can't convince the court that the vc admission to ol fungus tits is coercion, he could argue that Chris believed what he was doing was necessary, as ridiculous as that may sound. It's sort of like "Your honor, I had to pull the trigger, they kidnapped my family and threatened to execute my children if I didn't" style of duress. Not to mention that Chris has in the past been convinced to do things against his better judgement, such as the events of the Idea Guy saga or drawing himself dicking Sonichu in the ass the make his fantasy daughter. It's a longshot, but his lawyer may be able to spin it as that Skanke convinced him not that it was right or moral, but necessary for some bigger goal like the fulfillment of some retarded prophecy. Even if they find DNA evidence, it could be argued as transfer DNA.

All in all, Chris may not get away scott free, maybe not even with a minor sentence, but there's a possibility his attorney could get him a sentence on the lower end of the sentencing guidelines. Maybe 2 or 3 years, out in 18 months with good behaviour. I will of course defer to our resident legal eagles. If what I'm suggesting sounds retarded and infeasible, I'll accept that.

Not to power level too hard but I've had a court appointed attorney, and they were the absolute shits. They never answered my calls, no showed one of my dates, and then went on vacation and left some rando there to do fuck all on my behalf. This doesn't mean anything in the grand scheme of things, but its not a given that you get a good attorney or one that even gives a shit (especially in a smaller town).
 
What makes you think that the state is treating Chris any differently from any other defendant? It's in the state's best interest that a defendant has a good attorney so that they can't appeal on the grounds of insufficient council later on.

Without the possibility of pleading to a lesser charge, Chris is gonna dig his heels in and insist on fighting the charges.

Life is not a Perry Mason episode. If the jury is sufficiently outraged by the defendant's actions, then it doesn't matter how skilled the attorney is. Greene County is a pretty conservative place, and I doubt a jury is gonna take too kindly to a troon sexually abusing their senile mother.

My bet is whoever handles the public defender assignments twigged to the rather unusual, shocking and salacious nature of this one, “retarded tranny man child fucking his 80 yo declining mother” and decided to may need a more delicate touch in order to avoid any potential blowback down the line. Let’s be honest, from even a cursory glance at a summary, this is a weird one.

He’s still got the problem that he has an unmanageable client who’s actual competency to stand trial is right on the borderline. Having been inside one of said State Mental Facilities for the Criminally Insane a number of times (making “deliveries”) My professional opinion regarding your question is “EVERYBODY IN THE BUILDING!” You literally could not tell the patients/inmates from the staff.

The tin foil hats aren't really necessary here, IMO. Certainly isn't necessary to repeat the same "hot take" in multiple posts.

First of all, this attorney has experience with some fucked up cases, so it seems like a natural assignment just based on that. Second of all, it may be at least partially due to optics. Whether due to his status as being a slow-in-the-head, or the troonery, or the fact that he is one of the most-documented individuals on the planet, it makes sense for the court to choose strong representation for him out of their pool. Third of all, who else should this attorney be assigned to if not something demanding? It wouldn't make sense to assign him to a speeding ticket case while assigning some fresh-out-of-law-school dimwit to this case.

14BC's is so poorly kept that it's hard to tell if I'm looking at the front of the house or the back. Ruckersville is the worst of exurban sprawl. I know Chris moved there as an adult but I think the area he grew up in was part of the reason for his insanity. The foothills of Appalachia are a weird place from an urban planning perspective. Places like Ruckersville and Stanardsville have the worst of suburban and rural living because they were built far from centers of growth. Hence the unpaved streets and car dependence.

I'm going to have to dig into the recesses of my memory on this. I seem to recall two Best Buy incidents. Neither which I personally witnessed. If I claimed to have it must have been to protect the identities of the original sources and because people were(and still are) weird about alleged stories not coming directly from the source.

I was friends with a few people who worked at Best Buy. One incident included him throwing Pokeballs at girls to "catch" them. The other incident was him walking out of the store with merchandise. He was caught on security cameras. My memory is fuzzy on the outcome of that one. Either way, he ended up getting banned at some point. The Pokeball incident was in the fairly early days of Chris trolling where friends would be like "oh you know Chris Chan? Well here's a story when I worked at X place."

Another friend sort of witnessed the tail end of Chris getting kicked out of Target way back in the day. He was heading to the break room when he heard Chris' outburst about getting kicked out.

It actually gives the state incentive to solve the situation as best as they can, given that the longer it draws out the more billable time Chris' attorney racks up. It's only $90/hr, far lower than his going rate, but it still hurts the state.

I think at worst Chris will get some kind of plea deal.

94% of state court cases end in plea deals. This is not a bug, it is a feature. The laws are drafted such that the desired consequences are reached with a plea deal, with disproportionate punishment occurring when found guilty at trial. Trial by jury has mostly been eliminated in the United States as a cost-saving measure to allow increased numbers of prosecutions. The mass incarceration rate achieved in the late 20th century would not have been possible without eliminating trials, as the funding simply wasn't there to have so many.

Getting a plea deal is not a mercy, does not "get you off easy", make you lucky, or indicate a failure in what the system is trying to achieve. It is the system working as intended (though not how the founders of the constitution intended).

It's possible for him to not have to register as a sex offender. One incest conviction is not enough to require it. It would only be required if he is convicted of rape, or if he is convicted of incest with the assertion that Barb was incapacitated. Not having to register as a sex offender would be a huge encouragement by the prosecution to not go to trial and Chris' attorney would pretty much have no choice but to advise Chris to accept this deal with the strongest possible persuasion. 12 months in jail or even 4 years in prison would be better than 6 months in jail but being required to register for 10-15 years (or lifetime registration in the case of rape).

The sex offender registry is essentially a backdoor life sentence, and prosecutors wield it like a loaded gun to the head of the defendant. For first-time sex offenders, not having to register is often the primary encouragement to accept a deal.

It will likely go exactly like Chris' previous cases, just with more consequences. Pleading to a lesser charge (in this case, misdemeanor incest vs. felony incest and/or rape) will likely be at the crux of the deal. Chris will have months/years of jail time. Best case it resolves in about 6 months and he's let off on time served, which is far more jail time than the short weekend stint he had in the past.

I'm betting he is offered the maximum misdemeanor sentence of 12 months in jail. Chris' attorney will want to accept it, but Chris will object. Chris sucks at planning for the future. Either Chris' attorney somehow manages to convince him to agree, or he stalls until the state is willing to accept time served (Chris will probably not object to an agreement that gets him out of jail immediately, even if it's the exact same 12 months he was offered initially -- Chris lives in the present).

IIRC this *IS* Chris' childhood house, until he was moved to change school districts to get him out of special ed. He then had to move back because they were unable to sell 14BC and couldn't afford to keep two houses.

They will waive the jury trial because this is literally what *everyone* does. Trials are extremely rare. You only go to trial when either the defendant or the prosecution, or both, are retarded. In Chris' case he *is* retarded, so it may wind up going to trial, but Chris' attorney will probably be able to manipulate him into avoiding it.

EDIT: You also go to trial when you did something so heinous that the best plea deal you can get is life in prison, and your sentence if convicted in trial is also life in prison, maybe 4 life sentences like that means anything. e.g. you raped a dozen kids or something. Or incest cases where you raped your 8 year old daughter over the course of 4 years. In those cases the prosecutor can not in good faith offer you a deal that isn't basically the rest of your natural life, so you might as well go to trial since it buys you a little more time outside of prison at least.

What Chris did is not to that level. The prosecution can and will make an offer that is far less than the maximum possible consequences he could face at trial.
