The way I read this, it seems that the Court agrees that 128 (Notice of Voluntary Dismissal) managed to sneak in just ahead of the corporate defendants' filing 129 (Joint Motion to Dismiss), although the Court's tone in this order seems almost begrudging.
I suspect that the corporate defendants filed their Notice of Voluntary Dismissal without first doing a search to see if any further filings had been made. Perhaps a docket search on this case was done earlier that morning just before the paralegal or whoever drafted the filing started working on it, thus they didn't see the need to do another search immediately prior to filing. Either way, it seems like a simple timing issue and possibly a minor clerical error rather than the egregious disregard for due process that Stabbins makes it out to be.
It also seems that the view from my armchair wrt 132 and 133 being moot wasn't entirely accurate. I thought it'd make sfa difference as filing these would be like closing the stable door after the horse has bolted (see 128 ). If anything, 132 and 133 (especially 133) seems to have put Stabbins at greater risk of being sanctioned by the Court.
I get the feeling docket numbers will get used a lot ITT, as there's going to be a metric fuckton of filings with very long names that we'll all get sick of typing
