I think i remember alphabet commenting in there dismissal motion about acer cheating his 3 month filling rule by filing a lawsuit in a different place and then getting the lawsuit moved back to his place

Angering the Court by engaging in obvious gamesmanship before they rule on a motion that is at the sound discretion of the Court is clearly a winning strategy. Only David Stebbins, Ace Spergturkey, could come up with such a cunning legal strategy.
That order only applies to the Western District of Alabama, which is why he tried filing in the Eastern District before transferring to the Western District, like the retarded douchebag he is. The Northern District of California would have to declare him a vexatious litigant in order to apply a similar rule. Thankfully, he's well on his way.

Ah yes, lying to the court is clearly the best move to make in this case. That will go over very well. Also, there's no reason to add the corporate defendants as "nominal defendants" in this case, as the case could go forward without them being named. Further there's absoultely no reason to request injunctive relief from them either.
They are clearly not "nominal defendants."
