1. Plaintiff Acer, a recognized “vexatious” litigant (Stebbins v. Stebbins, 2013 U.S. Dist. LEXIS 93528 (W.D. Ark. July 3, 2013)), has asserted copyright infringement claims alleging that a handful of Individual Defendants posted infringing content on YouTube, Twitch, and Discord. Rather than simply sue the persons who posted that content, he also asks this Court to enter a needless and improper injunction under the Digital Millennium Copyright Act (“DMCA”) that would require the service providers – or their parent companies Amazon (of Twitch) and Alphabet (of YouTube) – to “permanently terminate” the “individuals’ accounts” and “not permit” them “to create any new accounts for any reason.” Dkt. 55 (SAC) ¶ 126. The Court should dismiss Mr. Acer’s claims against all Corporate Defendants with prejudice, and warn Mr. Acer that continued frivolous filings could result in sanctions.
   
   First, the sole work at issue in this case – a video of Mr. acer that was recorded
   accidentally through a fixed camera – is not copyrightable to begin with. Copyright protection
   subsists in creative works of authorship that are fixed in a tangible medium of expression by a
   human author. But here, Mr. acer admits that the video was created by accident, without his
   knowledge, and without the slightest spark of creativity on his part
   all of Mr.acer’s infringement claims should be dismissed without needing to go further.
   
   
   He is widely ridiculed by other users on those services, in
   large part because of his years’-long abuse of the court system
   has bogged down
   courts across the nation with frivolous lawsuits.

An update on his most recent lawsuit against Polano from the corpo suits representing Discord / Alphabet / Amazon (Discord, Youtube and Twitch respectively). I will get screencaps later after I am done with my night job. He is going to get destroyed and probably will get heavily sanctioned that he can't sue Null.

The Judge is going to rip into the fat fucker for this kind of conduct. And the judge should consider the contents of the MtD when looking at the merits of the default Judgment, even though the motion itself is moot. Right now, Acerthorn is probably rocking back and forth in front of his computer, making wild animal noises and muttering to himself under his breath, whilst smashing out some fresh lolsuits on his dried mustard and ketchup-encrusted keyboard: defamation suits against Sanjay M. Nangia, Davis White Tremaine LLP and Amazon the three attorneys that signed off this Motion to Dismiss because of this observation of the fact that Acerthorn is "widely ridiculed by other users" on YouTube and Twitch.

As an added bonus, he's probably going to try and sue Amazon, Google, Discord and the legal firms each of these respective companies has retained for vicarious liability over the actions of the three attorneys that signed off on this filing.

If as Acerthorn asserts, the filing of Dkt.128 Notice of Voluntary Dismissal closed this file on 11 April 2022 12:57 PST, this reply (Dkt.132) should also be dismissed as it was filed after 11 April 2022 12:57 PST, should it not? Ergo the Court needn't strike the Motion to Dismiss, nor would Acerthorn have incurred costs for an alleged "frivolous delay" as a result of Dkts.130 and 131 being filed. The Court wouldn't need to give the corporate defendents leave to re-appear in the case, as said case - according to Acerthorn - was dismissed as at 11 April 2022 12:57 PST.

Bear in mind I'm taking the validation of citing Commercial Space Management Co. v. Boeing Co., 193 F. 3d 1074 (9th Cir. 1999) on face value, as I'm not a legal Kiwi. All I know is that this case and the cited case are both Ninth Circuit and that I probably know about as much about the American legal system as Acerthorn does.
