Generally the person must be so mentally ill that they are unable to assist in their own defense. This ruling is requested by the defense attorney, who ostensibly represents Chris' interests. The defense attorney is supposed to do this to make sure that their client is in the best possible state to participate in proceedings and assist in their own defense.

Generally a defense attorney does not do this unless the client is actually behaving in a way that keeps them from getting the best possible outcome. Note that the attorney can't just declare his client incompetent, a judge has to agree and it has to be supported by psychiatric professionals.

If the prosecution tried to declare the defendant incompetent against the defense's wishes, it would most likely be denied unless they had some very, very compelling evidence, in which case any decent defense attorney would not be objecting.

The only issue is that in some places, historically, time spent in treatment did not count as time served. This is not the case in Virginia today -- any time Chris spends in a state hospital still counts as time served. This was also a way for the state to keep people locked up for longer than the sentence they could have received (either in terms of what was likely, or what the maximum was). The defense is also more empowered to fight against this nowadays.

Some states like Mississippi still abuse incompetence to keep people jailed for long periods of time without trial.
You may well be right. VINElink doesn’t show what facility he was transferred to and the only reason I can think of for that would be a transfer to a mental health facility or a hospital or something like that.

There is another and easier reason Chris could have been transferred to a mental health facility: He became a danger to himself or others.
Think of it: He goes through the holidays in jail, has a hearing that ends in another continuance (a 6 month one!), and spends his birthday in jail. He proceeds to go off the deep end. The jail decides it's in his best interests (and theirs liability wise) to transfer him to an acute care psych facility. He might return to jail in a few days or a week, but at least the jail can say they did their due diligence with getting him treatment.

Something Chris' parents sucked at doing. When it comes to Chris and his mental health the people he saw didn't treat him thoroughly, whether it be the psychiatrist in PVCC, or the therapist at Region10. They didn't feel he was a threat, just a harmless sperg. Maybe with this, it would give the judge the authority to finally get Chris into permanent psychiatrics care. I don't know how Heilberg is going to work his magic with this.

They have no idea what's going on, they can't know what's in the letters unless they read them which THEY ARE NOT DOING. To the guards Chris is just a weird retard who talks about being Jesus whenever they have to interact with them. Anyone who has ever been in jail, worked in a jail, or worked as a defense attorney or a prosecutor will attest that retards like Chris are a dime a dozen. If you go off of retards on KF Chris is up there with the worst but if you have ever interacted with the US legal system for an extended period of time you will meet people who do much, much worse. Chris is nothing compared to people who murder their own parents or their wife and children to have an affair or kidnap, rape and beat to death a toddler with two accomplices. Chris had (as far as the legal system says to our knowledge) consensual sex with his mother. He's charged with a relatively minor crime and being held without bond because he's not allowed home and he's in solitary because if he was in genpop he would get his ass beat just by being himself.

Like I really want to hammer in just how little what Chris sends out matters and how boring of a case this is to anyone who hasn't been following Chris since 2006. I know this has already been said a thousand times but apparently it keeps needing to be said.
You're absolutely right; I know jack and shit about the prison system.
 
That last letter made me pretty mad, goes from ‘We didn‘t have sex’ to some weird (Hopefully) awkwardly worded thing about not hating people if they share the same race as you to passively aggressively saying his mother should have been arrested.
One thing that will never (and probably can never) change in Chris is that everything ever that happens to him that is bad or inconvenient has to be someone else's fault. It is never his own fuck up or otherwise. The world is against him in his mind, and he can do no wrong– Especially not to himself.
 
So, basically he admits once again to r*ping his own mother.

What’s weird is that between his incoherent ramblings, you can tell that the seriousness of the situation has actually dawned on him. He refused to talk about his stay in the nut house.
It's more Chris deflecting the blame on Barb for being a sexually frustrated hag. Why else Chris would detail Barb's own Love Quest. True or not, offering your son sex after learning he did it with a hooker is not a normal reaction.
