I'm all in favor of Total Retard War but Fong-Jones seems like a better target for a mass site-funded lawsuit. The damages there are incalculable, and he's also a much better villain who would be much funnier to see take the stand.

My concern with defamation is that Epik will make the Rekieta argument: "Yes, we had actual malice. Yes, we knew it was false. Yes, we don't pretend to have ever thought it was true. BUT KiwiFarms is so bad, they're basically undefamable!" It didn't really work out for him, but I can easily see some mongoloid judge nodding along to it, or any other number of retarded reasons why KF is icky and therefore per se defamation isn't relevant.

I guess I just have less than no confidence in the courts. I honestly don't believe that there is any judge in the US who would resist the troon pressure and rule in favor of the Farms, regardless of the facts or law in question. Juries, maybe, but also doubtful. The various lawsuits Josh has faced are different up to this point since they're initiated by other parties, and those other parties are inevitably deranged retards like Greer.

There's no question that those tweets are 100% defamatory, and winning would be huge. But losing would also be really bad, and I'd say is at least 50% likely as a base.

As a person here who experienced a big part of the Weeb wars lawsuit, I have this opinion. Unless you have real, practical, experienced knowledge (like 4 reals cuh) from the industry or law, and in the particular state, it's wise not to opine. Let Null and his lawyer make the best decisions. Otherwise, this back and forth will just be a whirlwind of emotions and bullshit that will result in nothing productive and funny. Wouldn't part of proving defamation be the knowledge that the statement was false? Sounds like a pretty good way to lose 75 grand if they can just drop the case by saying "my twanny frens say it aaaaaaall the twme, how cwould I know it wasn't twooo"?

Wikipedia says nothing about it as of today but I'm sure they can find a couple hundred tweets echoing the lie, a clip from Lucas' stream or even fabricate a page on some website tomorrow that they can use to claim they believed it was a true statement at the time they were writing it.

By all means let's fucking sue someone and do our part in taking back the Internet - but is trying to sue for notably hard to litigate defamation perhaps not the best use of our collective money? The CP claim is probably what most people see as the aggravating part of the statement but does it make a solid case?

Very very likely. What epik did what outright admit in public that they broke the law/contract but knowingly did it. Add on the whole "hosting Child Porn" shit and epik has just committed slander and liable. Which normally is really hard to prove (you have to prove damages and that I knowingly lied to fuck up your reputation). If they only kept their mouth shut they would have been fine. But they in public shot themselves in the mouth to what, one up Josh? Any lawyer would take this case because it is open and shut. What I think Null should do is reach out (or have his legal team reach out) to Ben Shapiro's people. I understand the hold ups but this might be enough of slander to get mainstream right wing support.

The only thing when it comes to the "child porn" argument is for Josh to prove his site is us legal. Although and again I'm not a lawyer, but the otherside will have to PROVE that Josh willingly and knowingly has hosted Child Porn.


If I were @Null I would seek such a retribution that it would break the backs of the organization and scare the industry. If there's one thing the corporate world hates its lawsuits, even more if you're a litigious prick.
