From the wording and the rules cited it's apparent that Nick, once a stalwart advocate for court transparency until now, must have reacted to a certain spate of unwanted publicity by having his attorney file a June 20th letter asking for an emergency order that the presumptively public court file be made confidential until a "forthcoming Motion for a Protective Order" could be heard on that issue, as well as a June 21st letter request for a phone conference after court clerks refused to schedule one without the judge's say-so.

Surprisingly, although even the prosecutor anticipated no objection to such an order, the first available judge (who may or may not have been the case's assigned judge) took the time on a Sunday to issue the June 23rd written denial of the request, in part because the rules cited by White didn't even apply to this type of case in the first place, and in part because whatever the "information provided" was about the exigency wasn't enough for the judge to act unilaterally. This effectively decided to keep the file wide open to the viewing public same as before, and urged them to proceed by a proper motion and hearing like anybody else. What's especially odd is that in the 12 days since the June 20th promise of a "forthcoming motion" and in the 9 days since the June 23rd decision to keep the file public, still nobody has gotten around to actually filing the motion.

In the meantime since that unsuccessful flurry of activity, the still-public file has already had the interesting addition of the attached initial disclosures of what evidence the prosecution will be using at trial, some of which is new information. If you're Nick right now, wouldn't you wonder why more work hasn't been done to get this file sealed long ago?
