The reality is if it was only the cocaine molecule found in the test, and not any metabolites, the lab would have identified this as an anomaly - Minnesota Monitoring doesn't provide publicly how they interpret different findings, but I highly doubt the scientists and lab techs would look at such a result and fail to consider sample contamination as the most likely cause of the result.

And why would they not say 'That is CRAZY! Let's run the test again!'?

Then they go on to say that he privated the video on both platforms. Which is true, but they easily could have gotten a copy before then. He didn't private it until many hours later. I assumed they might have been watching live and gotten a copy immediately.

I always interpreted "taken off" as "downloaded from," but I guess that language could also support some other channel has "taken off" the video and the detective watched it there.
This says the cop viewed the video on the 22nd that were taken off of Youtube and Rumble, at an earlier time. Nick didn't private the videos until 10:30 the next day since he was wasted and passed out, so they were public for about 10 hours on the 21st. The cop could have easily archived the videos in that time, then made time on the 22nd to watch his archived version. Nick is trying to lie and make it seem like the stream was never public and there's no way the cops could have gotten it on without a warrant to Google.

This might be an American thing, but I interpreted 'off of' to mean 'taken directly from' and meaning they copied it directly from his channel. It could mean that the clip 'originated from the channel, but came to us by ways and various means'. It is unclear when you parse it down.

I think the funniest outcome would be the judge post-hoc justifying with 'Well, we found drugs, and you cannot show me exactly how it has been altered'.

The only reason I can think of to file the certificate of representation on the Sunday on the same day that Nick files the motion to dismiss is to try to delay the hearing by using it as an excuse for a continuance. That's certainly what it looks like, anyway

Its not really the 5th. Its all about Miranda rights. The police have to give the person a verbal miranda warning that they have a right to remain silent and a right to an attorney. After they give the miranda warning there are specific things the police cannot do. But the police can generally still talk to the person and there are many ways a person can make a mistake and void their rights in the situation.

Without the cam footage, there is no way to know what happened or if the statements are admissable.

No. They're merely implying it as strongly as possible without saying that. They're saying it was edited because someone clipped and added a watermark. And, on that basis, trying to present it as some kind of irreconcilably prejudicial tainting of the whole case. The gun distraction, on the other hand, reeks of Barnes.

There's little reason not to take a swipe at the search warrant justification at this juncture. It's low risk, high reward. If this is the best they've got, though, I wonder what the next play will be when/if it fails.

Filing a Motion to Suppress happens in virtually every criminal case because there is nothing to lose. a plea deal isn't contemplated before all these vanilla motions are filed and ruled on. It makes sense that he filed yesterday and I agree with all the others.. the hearing will take place, the state will say they need a little more time to respond to the motions, and it will be continued. It will probably last less than 3 minutes on Wednesday.

The state also likely doesn't have the lab report back yet that officially tests the drugs confiscated and officially reports what they were and on the actual weight of everything excluding the packaging. Again, no plea would be contemplated before these results are received because it can easily come back with the blow being under 25g which completely changes everything. This will drag on for months.
