This is correct, if simplified.
They raised the issue both in their Motion to Dismiss and during the Omnibus hearing.
But all actual lawyers laughed about it at the time, because Nick cannot invoke April's right.
During the Omnibus hearing the judge said it was something for motions at a later date, and the state supposedly (according to White) conceded that they would not use April's bodycam footage (of her singing like a bird as Aaron put it), White then requests that all of her statements should be excluded unless she testifies. (They raised this as a violation of Nick right to confront his accuser)
