Zell has been in the hospital for the past couple of weeks. I suspect drama/movement in his case soon.
So.. maybe someone can jog my memory but

Court listener shows nothing past Jan for the case where the judge ordered stabby to explain himself out of sanctions. Unless I misread that explanation is not filed and it's very past due date as all his appeals are denied or mooted and his stay only lasted till 10 days past resolution of appeal.

As of yesterday I did not see any filings from stabbins about missed payments..

Is he emailing the clerk or has electronic access or is he currently forced to snail mail. Afaik he doesn't have to snail mail so the lack of gobbling is . Odd?

I can't find all the court listener links but the ones I did check nothing is moving in any of his cases.

Is it normal for him to just go silent in fillings? This feels odd given he's obviously still online and not trying to pull a DFE/vanish/fake his own death scenario

Stebbins appealed. Stebbins got denied. Stebbins filed for a en banc(all judges) re-hearing at the circuit court level. There has been nothing since then.

Ah thank you I somehow didn't realize that while the appeal was denied the enbanc was still with the court.

Oh I see I was looking at the wrong docket. https://www.courtlistener.com/docket/68923062/david-a-stebbins-v-cmdr-imperialsalt/ at the lower court doesn't of course have the circuit court filings. Doh. Apologies for my retardation

Stebbins filed yet another petition for a writ of mandamus with the Third Circuit complaining that the Delaware judge in his cases against Spectre, Skibbity Dibbity, and Google is taking too long. For those unfamiliar, Stebbins opens a docket with the appeals court whenever he feels he is not getting enough attention from the district court.

Well at least this time he just left a message as no doubt the clerk was screening his call. Lots of heavy breathing, many frustrated sighs, grunts and panting...old Davey boy don't sound so gud. But nothing too crazy just the usual Mr Stabby annoyance at having to talk to other people.

A quick glance at this filing tells us nothing new, he's just bitching the judge hasn't ruled yet and is whinging like always.

hello i'm david stephens i'm calling in regards to case number twenty four dash one one seven three and one one seven four uh... stephens versus dough and stephens versus rumble and also miscellaneous case twenty four dash four seven eight uh... where i'm seeking a subpoenas and uh... it's been over five months and you still haven't with us still haven't issued an update on those cases
Um, and just wanted to know, I found a case law in the 3rd Circuit regarding, um, Ritz of Mendamus.
It's, uh, Madden vs.
Madden versus Myers 102, F3D74, 3rd Circuit 1996, where they basically said that five months of delay, even for a habeas corpus petition, which is way more complicated than my case is, five months of delay is concerning and while they declined to issue the writ, they did give the plaintiff a time limit 60 more days before he could refile.
So please if you can get my cases updated soon because I prefer not to have to go through a writ of mendamus Because that's supposed to be an extraordinary writ and yet five months it has passed and The third circuit in that case agreed that that was a long time and this case is way simpler than that case and
So, uh, please, I would really prefer if you were to just update the case of your own accord.

God, he's so bad at even leaving a message. So many "uhh"s, then he fucking cites case law in the voicemail as if it's a filing and he doesn't even have the case law he's citing pulled up at first, he's basically threatening to file a writ of mandamus if they don't do what he wants which I'm sure will go over well. But don't worry Dave! Your last writ of mandamus failed so surely this one will! Just had to warm up the table!
