Stebbins asks this Court to turn a blind eye to the manifestly transformative nature of Creetosis’ Livestreams and instead embrace a three-tier grading system of transformativeness that he apparently devised for his brief.

I'm starting to think this professional copyright attorney has a low opinion of Stebbins' lawyerly abilities.

The arguments themselves are pretty good too. He points out a lot of times Stebbins cites a case with a completely different fact pattern that doesn't apply at all. One time Stebbins compares the 19 hour livestreams dissecting his video to a case where one group printed a copied book word-for-word, and sold it in the same market as the original. Basically 90% of his citations are either incomplete, inapplicable, hold the opposite of what Stebbins claims, or he's just lying about the outcome.

The part about TOS is a pretty straightforward "no you're wrong you fucking idiot" explanation.

Stebbins mistakenly imagines that the license he granted YouTube distinguishes between claims based on whether they are labeled as “direct” or “vicarious” infringement.[] It does not.

I'm almost convinced that David has paid (or pirated) to get his hands on one of those Legal AI assistants made to help lawyers dig out references but instead of using the suggested cases David is just parroting what the AI says by rewriting it into his own gobbling style.

That said, I swear on any thing you like I try to keep stabbins cases straight and I cannot seem to. Maybe I need to create a tracker excel or something. In any case .. am I correct as to status of cases at the moment:

Stabbins vs lolcow - screeching at the court about ECF denial and basically making enemies without response needed from Hardin. Likely to be tossed when stabbins doesn't come up with the filing fee due to being rejected for in forma pauperis.
