I'd wager that it wasn't consensual (duh), but Barb still didn't see it as rape exactly. Even if she did, she wanted to protect her son so she didn't tell the police anything. Not convinced that the tag-team of Barb’s wall-eyed senility and Chris’s semen festering inside her produced a Catch-22 legal firewall to shield the Chandlers from harmthe results were positive for Chris's semen in her vagina. Chris was also openly admitting the affair at that time, although he has recanted those admissions.
My theory - and it's only speculation - is that Barbara refused to talk to the police, so they cannot prove whether the affair was or was not consensual on her part. This protects both her and Chris: since they can't prove that she willingly took part in the affair, they can't win a case against Barbara. Since they also can't prove that she wasn't a willing participant, they can't charge Chris with rape.

He was held without bail. I don't think he ever had a bail amount set, the judge likely felt it was wrong to just hold someone alone in a jail cell for 20 months and got him out when a place for him to go finally opened up.Could the Judge have lowered bail in one of these recent hearings?
