I don't disagree with you in theory but in practice you aren't even in the country. You've never lost a lawsuit but all your lawsuits are against retards who don't know how to file anything.

If you only have a 15% chance of success I don't think it's worth expending 75 grand on. And what happens if you start collecting donations and you fall short? Say you only get 6000 dollars, are you going to refund all of that?

Release of information would end up being very limited, and probably redacted in the public record. If they're saying something is hosted, they can't just go on a fishing expedition to find it either, they have to show where it is specifically.
It sounds like you're thinking of warrants, not discovery. Discovery doesn't need to specify where documents can be found, just categories of documents that could potentially contain pertinent information. Since the factual allegation is "certain material was hosted on the site", then a complete picture of all of the material hosted on the site is potentially relevant.

And the material wouldn't have to be in the public record for someone to slip LFG a copy.
 
Epik LLC has made two claims on X :
1) They were forced to put a clientHold on kiwifarms.net by Law Enforcement, which we evaded by moving the domain out of the country.
2) That the Kiwi Farms "hosts child porn".

These are both false, and these are both instances of actionable per se defamation. The damage of these claims is inherent in the claim and they are already being parroted by adversaries for the purposes of trying to further erode our ability to find stability and sure footing on the Internet.

Epik is a Wyoming LLC, X is a California LLC, and Kiwi Farms is a West Virginia LLC. To pursue this, I would have to find a lawyer in one of these jurisdictions. I don't know any.

Taking a case to trial is at least $75,000. However, they would be able to pay because they are a big company, and this would be an amazing step for being able to show providers: Yes, we are legal, and yes, we are taking steps to remedy actionable defamation to the contrary.

I've put up a poll. I am already dealing with litigation and saving money for another case. Would the community itself actually want to finance litigation?


Edit: I will find a way to get fiat working so you don't need crypto, but special crypto wallets can also be set up.
Epik has been a giant shit show. See the Namepros thread. They're losing domain regs meaning the company will probably fold soon. No one who is owed money (millions!) seems to know who the new owners are either... if they are even new at all. Epik has not and probably cannot pay the people demanding money from them now (Epik's escrow sold domains from third-parties and kept all the money).

Sue an established business with lots of money and known owners/ooperators like Cloudflare.
 
If cryptocurrency isn't an option, I think prepaid Visa/MasterCards work. I've never been asked for an ID anywhere in the west when I purchased them during the holidays.

The money in there can be funneled using services like Revolut.
More info on this process, if you have it handy, would be appreciated for us old-timers. I did crypto once to Null, it was a pita and I'd rather just send a damn money order out. I will commit $100 and have to hit the bank this week anyway.

Normally I'd take a similar view, but in this instance a 15% chance of success for $75k is better than a 0% chance at $0. Especially when one is playing for something that's impossible to put a price on.

Of course I'm going to buy some Total Retard War Bonds (may not be actual war bonds) to help fund this litigation.

  1. Is this an effective way to donate?
  2. Can your financial institution trace the transaction? Like, if I pay cash for a gift card at my grocery store is that sufficient opsec?

Cash is king and Lolcow LLC accepts cash through mail by money order. Head to your local post office and they will take your cash plus a small fee (like 2 bucks) and you receive a paper slip that Lolcow LLC can deposit for exactly the face value. They'll even sell you a stamp to mail it with! You can choose to leave your name off the money order and you bank would only ever know you withdrew cash.

What's a couple bucks and a stamp in exchange for your anonymity? Unless you want ass pats, then write your username on it or something.

I dont know, if I had to guess with the fucked up court systems and KF's bad rep, they could just shrug it off "Oh, well it looked suspicious, whoopsie daisy". I dont know if that would hold up or not though, I'm a plebian, not a lawyer.

The more likely outcome is that they end up retracting the statements and put a more sane person in their place. A public retraction is as good or better than any win in a lolsuit.
Seems like a waste of time and money. Could he prove financial damages due to this and get recompense? I doubt it. At best Josh could point to his victory and watch the world continue to ignore him because he's a bad goy who wields a permanent N-word pass and makes the tranny golems seethe.

Like I said though, whatever he decides to do is fine by me, all I know is I know nothing.
