Definitiv sehr interessant aber sollte er wirklich in Berufung gehen wird es ja noch mal eine Stufe höher gehen in der Hierarchie der deutschen Justiz (wenn man das jetzt so sagen kann lol) und dann werden ja auch die Richter ausgewechselt die eine andere Meinung haben können oder sehe ich das falsch? Also wird es vielleicht sogar eine klitzekleine Möglichkeit haben das er doch auf Bewährung kommt (ist natürlich extrem unwarscheinlich aber möglich behaupte ich mal)

I don't know much about this guy, but assaulting people is not okay even if you're a german. This is a crime as per the Geneva Convention. He obviously can't control his anger (he was drunk, right?). If he would like to be arrested and punished by the german government, this would be the perfect way to go.
i know you are joking but the sad reality is that he wasn't drunk 99% of the time he did this shit
 
So when will he actually be moved to prison? Could he have just gone home after the trail, or do they put him away immediately? Now that the good people of Altschauerberg are so close to freedom from the Ogre´s tyranny, it would be a terrible shame if the police just let him return for even a few days. The amount of retards that will swarm the Drachenschanze to catch a glimpse of him before he gets locked up could get real bad.

I originally wanted to post in german, but gave up halfway through. Five years of misery in german classes apparently weren´t enough to teach me how to make a decent forum post. What was the fucking point.
He'll go home since he's not seen as danger, in danger of fleeing and wasn't in Untersuchungshaft either. He'll eventually get a letter that states the time of the beginning of his prison sentence and where it begins. He then has to show up at jail by himself at the specified time. Usually some time is given so people can get their affairs in order. The goal of prison here is not to destroy a persons life as quickly as possible by tearing them out of it in the most brutal way, but to do it in a way that people still feel part of a society. This can theoretically take months. If he doesn't show up a warrant is put out for his arrest and he'll go immediately to prison when caught. If he goes into revision regarding his sentence, the sentence is for the time being invalid and he doesn't have to go to jail and the whole process will basically get a "do-over" with everything from the beginning. Seeming how clear cut the case is and how quickly the judge gave him the sentence It's very unlikely to change the result though, it will at most buy him some more freedom time before his sentence. Because this whole thing is incredibly low-level and basically the german legal system is very lenient on white trash doing white trash things, (as long as the white trash does it to each other) this all can really take a while. It's kinda surprising it went as quickly as it did, really and has probably more to do with his relatively high profile in media around here. In comparsion, nobody besides dedicated autists really know Chris-chan really but Drachenlord is seen as enough of an oddity that he does get mentioned in mainstream news. It mostly has to do with thousands of people invading a small bavarian village with a population of less than a hundred people.

If he does very well in prison and it's the view of the prison authorities that he's really a changed person (usually mostly because of work details he did in prison or educations he pursued) he could be free again after a year. This is voluntary and people actually can decide to stay in prison for their full sentence instead.

Also, choosing 2 years instead of 2.5 like the state prosecutor asked for most likely makes an appeal a lot harder - if not outright impossible: The only difference between what Rainer got and what his lawyer asked for is probation. Given that he already was on probation and the new accusations of assault are pretty serious charges in and of themselves... well, he's fucked. Not like there was any doubt about it, mind you, but Rainer's lawyer should make clear that the appeal is at best just going to buy time. There is not the tiniest bit of wriggle room here.
An appeal would most likely be rejected. The judge can rule whatever length of sentence she likes (within the legislative limits). An appeal would have to point out an error in her judgement or make the point that not enought evidence has been brought fourth (in this case to defend Rainer) to have the case revisited.
Both seem highly unlikely, given that all parties agreed on cutting it short and not hearing all the witnesses (I assume Rainers defense didn't have any witnesses in Rainer's favour since the attacks and his libel and insults were all on video lol).

In short: He may appeal the sentence, but it will be rejected after the next higher court checks the case records. So he will most probably go to jail early next year.

PS: I bought a bottle of champagne in case his next stream will be of the extreme Brüllheul-variety. I am not expecting him to do a Heul-stream until his appeal gets rejected.

Edit: I also sincerely hope, given the length of the Sentence (2 years + 7 months), that he will start an apprenticeship in prison or get his basic education (He didn't graduate his sped school successfully, although the sped schools in Germany allow their tards to at least get a "Hauptschulabschluss" if they are smart enough.) Even if he chooses to keep his Youtube lifestyle (if anyone will remember him then), getting an apprenticeship would probably benefit his brain in the long run. He got even dumber the longer he was on YT IMHO.

Technically. Many Civil Law countries treat "insults" as criminal offences on paper. One thing to consider is that those laws are really old. Like, early-19th-with-roots-in-18th-century old. Some of the definitions have very archaic wording, along the lines of, "that which harms one's honour and standing".

Most importantly, these laws tend to pre-date the introduction of proper constitutions and rights. So, in practice, constitutional guarantees of freedom of speech have all but overwritten these laws in many instances by taking precedent. What's "insulting" is ultimately subjective, and a judge faces a conundrum when he's confronted with a statement that is both true and insulting. Nearly all will err on the side of caution and stick to the constitution. That is, assuming the case even makes it to court. Obviously, a criminal complaint boiling down to, "X called me a poopiehead" are not going to be high on an overworked police force's priority list.

The one notable exception to this trend are police officers themselves. Many Civil Law law systems actually list "insulting an officer in the line of duty" as a seperate criminal offence, along the same kind of logic that they're representing the law and justice that justifies contempt of court charges. Practically, it's an excuse for cops to throw the book at particularly annoying and/or not technically law-breaking arrestees. Think of it as similar to how charges of "disorderly conduct/disturbing the peace" often work (which, conversely, is a very Common Law concept that many Civil Law countries don't have a real equivalent for).

Interestingly, it seems Germany does not have this provision. Werner was charged and convicted of 'Beleidigung' full stop. Like others have said, he's been flinging insults at the popo for fucking years at this point. If German law enforcement really cared that much about insults as a criminal matter they would've cuffed him after the first 911 call. It's very obvious they're throwing everything that'll stick at him because they're sick and tired of his antics.

The problems with Rainer are that he usually went out of his way to confront and attack people and you can't really claim self-defense when you go confront and attack whoever's bothering you.
That's the crux of the issue: if you go out of your way to escalate a situation, then you have now become the aggressor. The parameters of what constitutes 'self-defense' don't even matter, because what you are doing can no longer be reasonably said to be self-defense.

It's no different in the US, despite what some future Boogies might tell you. You brandish a gun for the sake of brandishing, you done goofed. You flee from a confrontation only to return, you done goofed. You fire off a 'warning shot', you done goofed. You put a round in someone the second after it can be proven he was a credible threat to your person, you done goofed.
 
The thing is: In Germany you don't get prison time for each crime individually and get an added sentence of smth. like 400years, like in some cases in the USA.

If you do crimes in conjunction with each other, the worst crime will stick and the others will be used to make it evident that you really deserve the (e.g.) maximum time for that crime etc.
What I don't get is, that they were so nice to Rainer and made a trial for both cases of assault (with a weapon, aggravated?) and the libel/insulting of the police officers together.
Almost everything happened weeks from one another, so they were really nice to try him like that. (Can a German law sperg maybe chip in and tell me if this is normal?)

Think it can go either way with him, sometimes he's surprisingly un-retarded about some things. He'll either be extremely angry to the point that I'd worry about the haiders that show up beyond this date or he'll be in full smug unbesiegt mode and basically act like this all will be over with the appeal. Time will tell.

Also dude went patrolling around his village with sticks and attacked and yelled at random people who not even always were his haiders. Don't think there's any wiggle room for "self defense".

The police was actually extremely nice to him in the beginning, they even sort of took pity on a personal level on him too for a long time. (Where he is is really bumfuck-nowhere-everyone-knows-everyone county, they are not battle hardened inner city cops) Eventually they were just fed up, there really was no abuse of their power in regards to him.
 
Maybe things would have gone differently if he chose something else to wear. He does own some polo shirts and has cash to spend. Not sure what the plan was here:

Insults are not covered by free speech. And he wasn't sentenced for the insults, he was sentenced for repeated aggravated assault, violating his probation and somewhere a couple tiers down also for calling specific cops incompetent bastards.
Dann hat Deutschland keine Redefreiheit, lol. aber das weiß jeder, denn selbst wenn man verbotene themen wie den holocaust erwähnt, wird man vor allen juden verhaftet und vergewaltigt. Abgesehen davon, ja, er wurde wegen Körperverletzung verhaftet. das Fehlen von Rederechten in Deutschland ist jedoch abscheulich.
 
Because of the occasion, I went through some of his old stuff today and it's crazy how much worse he looks now. Way at the beginning he was certainly fat and looked like your none-to-bright metalhead but he looked pretty normal. In comparsion to that, he's a total wreck now. He even sounds more unhinged. Give me all your rainbows but maybe prison will reset his life a bit. As so often, somebody should've cut his internet down years ago.
