I was just watching the replay of the Potentially Criminal/Gosney stream they had right when the doc got leaked.
I don't believe I saw this mentioned in the thread: CGoody was in the chat (around 56:40), and surprisingly enough, he wasn't sweeping. Aside from "Nick never tells me to ban people," but that's more ass-covering than sweeping.

I remember being 9. I can't imagine what I'd have done on hardcore stimulants, but it would have certainly included some heavy property damage or arson. What a stupid idea. Joking aside, I'm actually in the "sudden family medical emergency was an accidental overdose" camp. The kid probably found a container lying around and decided to use is as a condiment on her spagettios or something, out of pure curiosity. God knows there wasn't much supervision at the coke hovel. As to why the child wasn't driven immediately to the hospital? The parents (and the hotwife) must have decided that they would rather risk the child's death rather than risk being outed as junkies. Well, they've been outed anyways, and who knows what sort of trauma and damage the kid now has because she's been denied proper medical care. I hope this speculation isn't true, by the way, but it does seem to be firmly in the realm of possibility. Then again, the realm of possibility happens to include things like "the 'knowingly permit sexual abuse' charge wasn't a typo after all."

Been a while since I did law so treat this more as an educated guess than actual expertise.

If I was the state prosecutor, it might be worth considering Josh as a witness regarding his drug use and noted negative behavioral changes because.

1. He is a proprietor of a website that actively documents and disseminates information regarding Nick.

2. Josh has had direct communication with Nick and has publicly stated he has spoke about related subject matter via electronic communication

3. He is currently obtaining the video tape of the arrest and depiction of his house.

I would subpoena these communications and potentially Josh himself to impeach Nick’s defense and credibility. Thus, X(Formerly known as Twitter), his website discussions/dms, and phone conversations might be subpoenaed.

Though not as many, there are a few reasons Nick’s defense could subpoena Josh

1. Highlight Josh and his website as super mega Hitler particle abundant to show certain evidence may not be credible tldr “Das nawttruuuu!”

2. Subpoena communications to show potential exculpatory evidence

3. Not legal related, but to force Josh to testify becausehe knows our dear Josh is notably camera shy and would probably be what Nick could do to be vindictive

I can’t guarantee he will be called to the stand, but I can almost guarantee he will be subpoenaed for his communications. I would recommend he speak to Harding on this matter. (I'm sure he has/will)
I think everyone is vastly overestimating the resources a county DA is going to put towards a Mickey Mouse, pretty straightforward possession case. They might go an extra mile due to Nick being a lawyer and the public attention, but he’s not going to bust the office budget to doggedly pursue every spec of possible evidence. This isn’t murder one, it’s not a CSI mystery. They got a warrant and found coke, very cut and dry. It’s almost inconceivable it will go to trial but Nick might be that retarded.

It’s just a shame Nick can’t be prosecuted for being an absolute retard and legendary douchebag, but that’s the world we live in.

From the doc, the indication that only the one kid returned a positive result (and a result that is insanely high for a child) indicates (to me) that this is not a single exposure event but a result of significant 'over time' exposure

We cannot make any scientific claim about single vs. multi exposure to cocaine from the report data that is currently available. That was the core of my reply and is why I provided example slides from hair test sectioning (a test which would give information on whether the child's cocaine consumption was a single event or was ongoing, and for how long)

This simply does not happen, and is not possible if they detected cocaine metabolites. The child's levels are too high (5000 pg/mg = 10th percentile for adult cocaine users, and 30th percentile when adjusting for the child's body mass or surface area)

Transfer like that is not realistic, unless Lord Balldo is claiming he regularly peed urinary metabolites like benzoylecgonine (BE) onto his daughter's hair.

Nick - if the government test is bullshit then I challenge you to go to court and commission an independent hair follicle test for your daughter , with sectioning. Then release the results publicly to clear your name.

But we know you won't do that because these results are real.

Cocaine is on Schedule II because there are legitimate medical indications for its use as a topical anesthetic and numbing agent. Depending on where the testing antibodies latch onto the metabolites, maybe other tropane alkaloids, like atropine and scopolamine could yield a false positive. So yes, a positive test above the amounts associated with legit use calls for a second test to confirm the molecules you're dealing with.

On the other hand, letting your kid chew on jimsonweed may actually rank higher in irresponsibility than feeding them cocaine.
 
Amide anaesthetics won't ping a false positive for cocaine. There aren't any medications that will. The most plausible scenario where the kid wasn't using cocaine is that the lab techs just completely shat their pants and and mixed up her paperwork with a crackhead's somehow.
I would think any test result showing so high on an 8 or 9 year old will trigger somebody, either the lab or CPS to kick it back for a retest to confirm.

Why would it complicate the Prosecutions case? This is not the prosecutions document. This was something publicly available at the Courthouse. The only thing questionable about it is the failure to redact the children's names. That failure has zero impact on or benefit to Nick.

It's the whole Occam's Razor thing. You find a 9 year old testing positive for moderate weekly cocaine injestion in a house with 26grams of cocaine. It's probably not a false positive from her Ritalin, cough syrup or Flintstones vitamins. Often the worst is the most probable.

And honestly that's not even assuming the worst. To fully appreciate the true "worst" you have to pan back a bit and look at the entire scene. We have;
- a pack of sexually deviant adults, both parents and unrelated adults, engaging in rampant hardcore and ever more bizarre and extreme sexplay in the house with 5 young children.
- a metric crapton of drugs and booze. Including dealer levels of cocaine, ketamine a famous date rape drugs, whatever the brown shit is, and whatever was in Mommy's special medicine bottles.
- the 8-9 year old girl, and ONLY the 8-9 year old girl tests positive for cocaine use at a level far above environmental or accidental contact.

Pop Quiz fellow Mandatory Reporters; what question or scenario immediately springs to mind given this set of facts? Why does only the 8-9 year old girl seem to have been involved with the drugs, in a house full of sexual deviants?

If you're now feeling nauseated at the possibility, congratulations, you've figured out the worst case scenario that is now on CPS and Law Enforcements radar. Hopefully it is not what happened for the kids sake. But at some point somebody is going to ask that question.

I was reading earlier about hair follicle tests - the steps always included washing the collected sample to remove contaminants. Wouldn't that remove the norcocaine on her hair from contact?
The metabolite is incorporated into the hair itself. You'd likely have to breakdown the hair during the wash step for it to be removed.
